단말기유통법 개정 논의의 검토

국문 초록

단말기유통법 제정 이후 2년이 경과한 시점에서 동법에 의하여 도입된 규제의 실효성 및 타당성에 관한 논의가 필요하다. 동법은 이동통신시장에서 나타나고 있는 불투명하고 차별적인 보조금 지급이 소비자 후생 배분을 왜곡하고 이동통신시장의 건전한 발전을 저해하는 등 문제점을 낳고 있다는 인식에 기초하여 제정되었다. 그러나 동법이 제정된 이후 애초의 입법 목적이 충분히 실현되고 있는지에 의문이 있다. 지원금 규제에 의하여 기대되었던 단말기 및 통신 요금의 현상은 나타나지 않고 있으며, 궁극적으로 통신 시장의 고착된 경쟁 구조도 큰 변화 없이 계속되고 있는 상황이다. 이러한 상황은 단말기유통법상 제도의 실효성이나 타당성에 의문을 낳고 있으며, 단말기 상한 규제와 같은 일몰제 형식의 규제의 경우 규제의 계속을 수용하기 어려운 요인으로 작용하고 있다. 그러나 동법에 의하여 의도되었던 목적, 즉 유통 구조의 개선이나 바람직한 경쟁 상황의 구축 등은 그 실현에 상당한 기간을 요하는 것이며, 다양한 요소의 종합적 고려에 의하여 장기적인 관점에서 판단되어야 할 문제이다. 오히려 거래 주체들의 자율적인 조정 가능성을 확대하기 위한 제도들의 보완이 요구되며, 이러한 방향으로의 법 개정이 필요할 것이다.

영문 초록

“Law on the Improvement of the Mobile Terminal Distribution System”(Mobile Terminal Distribution Act) was enacted in May 2014, and conducted from October. While the enforcements of Mobile Terminal Distribution Act have elapsed more than two years, but matters that need improvement in the new system operating have been revealed. So in the current law, it is required to review these matters. The main motive of the legislation of Mobile Terminal Distribution Act was to eliminate the disadvantages of the user. Such disadvantages in the mobile market have resulted from unclear and complicated subsidies at the purchase of mobile terminal, paid by communication common carriers or terminal manufacturers. The aspects of purchasing mobile communications services and terminal device at the same time have made more intensified complexity of the matters about the subsidy of the mobile terminal devices. Mobile Terminal Distribution Act is an outcome of the legislative work to solve this problem, but of course this act itself in not perfect. The restrictions on discrimination in subsidies are strengthened, the upper limits of the subsidies are made, or the obligations about the disclosure of subsidies and the submission of the related materials obligation are imposed by the enactment of the law. At the moment, it will be rather premature to anticipate the mobile market to normally work after the enactment of Mobile Terminal Distribution Act. But reviewing the matters revealed as a result of the enactment of this Act, an in-depth considerations of competition activation elements have been lacked but regulations of competition by terminal device subsidies. In particular, it is necessary to consider introduction of the separation pricing systems of the terminal devices and the communication services positively and the discriminative regulations of subsidies
