국문 초록

인도네시아 경쟁법은 1999년 제정되었다. 동 시기는 인도네시아 경제가 심각한 위기 상황에 빠져 있는 상태에서 오랜 시기에 걸쳐 계속된 권위주의적 정치체제가 민주적으로 전환하는 시점이었으며, 경쟁법의 제정은 이와 같은 시대적 전환기에 개혁 입법으로서의 의미가 있었다. 비교적 최근에 이루어진 인도네시아 경쟁법은 내용 측면에서 주요 선진국의 경쟁법을 입법모델로 하여 제정되었으며, 각 국의 제도를 수용하고 종합하여 이루어진 것으로 볼 수 있다. 특히 법위반 유형을 공동행위와 단독행위를 구분하여 규제체계를 구축하고 있다. 그러나 법제도 측면에서 인도네시아 경쟁법의 고유한 특징도 드러나고 있다. 대표적으로 독점에 대한 대응은 입법 방식으로서 원인금지주의와 폐해규제주의로 대별할 수 있는데, 인도네시아 경쟁법은 두 가지 입법 방식을 모두 수용하고 있다는 점이 특징적이다. 이와 같은 법제도를 어떻게 조화시켜 나아갈지는 인도네시아 경쟁법의 과제라 할 것이다. 또한 비교적 최근에 이루어진 입법이긴 하지만, 향후 법집행 경험의 축적 과정을 통하여 제도 개선이 이루어져 나아갈 것으로 기대된다.

영문 초록

Competition Act in Indonesia was enacted in 1999. In that year the Indonesian economy was stuck in a serious crisis situation, and such crisis had triggered the transition from authoritarian political system continued throughout the state for a long time to a democratic political system. The enactment of competition Act had represented legislative reform in such a transition. Indonesian Competition Act was enacted by the legislative model of competition laws in major developed countries. In particular indonesian Competition Act included prohibited contracts, banned activities, abuse of market dominant position. However, in terms of the legal system indonesian Competition Act is also brought to light the unique features of the Competition Act. For example, indonesian Competition Act had both the regulation of monopoly itself and the regulation of abuse of monopoly(market dominant) position. How to harmonize two regulation systems would place the task of Competition Act in Indonesia. As law enforcement experience has been accumulated, the regulation systems in Competition Act would be expected to improve.
