전기통신사업법상 이용자 차별 규제의 법리적 고찰

국문 초록

전기통신사업법은 통신사업자의 차별 규제에 관한 규정을 두고 있다. 특히 동법 제50조 제1항 제50조 제1항 제5호 후단의 이용자 이익 저해행위에 해당하는 행위로서 동법시행령 <별표 3>은 이용자 차별에 관하여 규정하고 있다. 우선 경제 영역에서 이용자 차별은 경쟁정책의 관점에서 부당성을 판단할 수 있다. 즉 경쟁 사업자를 당해 시장에서 배제할 의도로서 차별을 행하거나, 또는 유통 과정에서 다른 사업자의 시장 봉쇄를 목적으로 차별이 이루어질 수 있고, 이러한 경쟁상의 침해에 기초하여 이용자 차별의 부당성을 인정할 수 있을 것이다. 한편 전기통신사업법 고유의 통신이용자 이익보호적 관점에서 부당성을 판단할 여지도 있으며, 이러한 관점에서의 부당성 판단과 관련하여 최소한으로 보장되어야 하는 통신서비스의 내용이 중요한 의미를 갖는다.

영문 초록

The discrimination in trade occurs when the same commodity that would have same cost basis is sold at more than one trade conditions. Most countries that have competition Law has regulated the price discrimination, for example The Clayton Act Sec. 2 in U.S.A., amended by Robinson-Patman Act. Though many questions has been raised on the reasonableness of the regulation on the discrimination, if the discriminations lessen or restrain the competition among the competitors, it should be regulated by competition law. In Korea, Fair Trade Law has expressly prescribed the discrimination in trade as an unfair business practices on Article 23. But the discrimination in trade could be regulated as an abuse of market-dominant position in accordance with the provision of Article 3-2. These regulations would be justified in perspective of competition policy. Such a perspective of competition policy would apply on the regulations of the discriminations among the users that would make use of same telecommunication services in Telecommunications Law. But the perspective of user protection would have an important roles in the regulations of discriminations in Telecommunications Law.
