디지털 뉴딜 관련 데이터 법제의 입법 방향에 관한 연구

국문 초록

대한민국 정부는 2020년 7월 14일에 코로나 19사태 이후 경기 회복을 위한 국가 프로젝트로서 2025년까지 디지털 뉴딜, 그린 뉴딜, 안전망 강화의 세 개 분야별 투자 및 일자리 창출계획을 발표했다. 한편, 시민단체들은 이러한 계획은 ‘데이터’의 활용에 관심을 높여 그 데이터에 포함된 ‘개인정보’의 부당하게 확대된 활용을 할 것이라는 비판의 목소리를 높이고 있다. 특히, 개인정보보호위원회와 달리 별도로 개인정보 활용을 위해 데이터청을 설립하는 것에 우려를 나타낸다. 정부의 ‘디지털 뉴딜’ 대표과제인 ‘데이터 댐’ 사업에는 민간기업을 중심으로 관계부처와 공공기관이 참가한다. 이 기획은 AI 학습용 데이터 구축, AI 바우처와 AI 데이터 가공바우처 사업, AI 융합 프로젝트(AI+X), 클라우드 플래그십 프로젝트, 클라우드 이용바우처 사업, 빅데이터 플랫폼 및 센터 구축 등이 포함되어 일자리 창출과 경기부양 효과는 물론 미래를 위한 투자와 각 분야의 혁신을 동시에 추진하기 위한 것이다. 한편, 세계는 디지털 전환을 산업과 경제의 새로운 혁신을 진행하고 있다. 코로나 19로 인한 사회 경제적 대변혁과 함께 정부는 전 국민의 ‘생산적’ 정보 활용역량 제고와 분야별 디지털 혁신을 위한 맞춤형 대응방안을 마련해야 한다. 이런 점에서 디지털 뉴딜의 방향성은 디지털 전환이라는 세계의 변화와 일치하는 것으로 그 방향성과 시기에 적합한 것으로 보인다. 디지털 전환의 시대에서 디지털 뉴딜 계획은 데이터 활용과 개인정보의 보호는 함께 도모되어야 한다. 그러기 위해서는 현재 데이터 법제의 입법 현황을 정확히 파악해야 한다. 그리고 개인정보 보호법은 대한민국의 개인정보를 보호하고 합리적인 활용이 가능할 수 있는 데이터 관련 기본법의 위치를 정립해야 하며, 이를 기본으로 디지털 뉴딜과 데이터 법제의 변화를 추진해야 한다. 이를 위해서 개인정보 보호법의 개념들은 더욱 명확하게 규정되어야 하고, 형벌규정 보다는 다양하고 효과적인 규제방식을 합리적으로 사용해야 한다. 그리고 신용정보법과 데이터 기본법안 등 다른 법률도 정보보호와 데이터의 합법적 활용이 가능하도록 입법되어야 한다. 나아가 개인정보보호위원회에 의한 개인정보 보호에 관한 일관적인 규범 통제가 가능하도록 하는 법 개정이 계속되어야 한다. 이와 같은 개인정보 보호의 합리적인 틀 안에서 각 조직의 디지털 전환과 정부의 디지털 뉴딜 사업, 그리고 데이터 댐 사업이 AI 등과 결합한 실효적인 사업이 되도록, 법제도의 검토와 합리적인 입법 추진이 계속해야 할 것이다. 이때 데이터 법제 전체를 고려한 입법이 필요하며, 정부는 부처 이기주의에 따른 법안의 입법을 경계해야 한다.

영문 초록

On July 14, 2020, the government of the Republic of Korea announced a plan for investment and job creation in three sectors Until 2025 as a national project to recover the economy after the Corona 19 incident. Meanwhile, civic movement groups are raising criticism that such a plan will increase interest in the use of “data”, and that the “personal information” included in the data will be unfairly expanded. In particular, korean civic groups expressed concern about establishing the Data Office to utilize personal information separately, unlike the Personal Information Protection Committee. Related ministries and public institutions, mainly private companies, participate in the “Data Dam” project, the representative project of the government’s “Digital New Deal”. This plan includes building AI learning data, AI voucher and AI data processing voucher business, AI convergence project (AI+X), cloud flagship project, cloud use voucher business, and big data platform and center construction, creating jobs and stimulating the economy. This is not only for the economic effect, but also for investment for the future innovation in each field at the same time. In the era of digital transformation, the digital New Deal plan should be linked to the rational use of digital together with the protection of personal information. Then, it is necessary to accurately grasp the current status of the Personal Information Protection Act. In addition, according to the PIPA, a system such as the Digital New Deal should be promoted according to the overall design that can protect the personal information and enable rational use. For this purpose, the concepts of personal information and data should be more clearly defined, and various and effective regulatory methods should be reasonably used rather than penal regulations. In addition, other acts, such as the Credit Information Act and the Data Basic Bill, should be legislated so that data protection and legal use of data are possible. Furthermore, the amendment of acts must be continued to enable consistent control of the norm of personal data by the Personal Information Protection Committee. On the reasonable framework of personal information protection, legal system review and rational legislative promotion should continue so that the digital transformation of each organization, the government s digital New Deal project, and the data dam project become an effective business combined with AI. At this time, the government should considers the entire data legislation, while caution of legislative activities on the ministry’s egoism.
