사회통합의 관점에서 본 기본소득의 가능성과 한계

국문 초록

사회통합은 국가를 구성하는 원동력 즉, 헌법을 형성하기 위한 조건임과 동시에 형성된 헌법이 제대로 기능하기 위한 조건이다. 본 논문은 사회통합의 실현과 관련하여 최근 주목을 받고 있는 기본소득이 긍정적으로 기여할 수 있는 가능성과 그 한계를 검토한다. 기본소득의 의미, 헌법적 근거와 법적 성격을 살펴보고, 사회통합의 헌법적 의의와 함께 정치적, 사회경제적, 문화적 영역에서 통합을 실현하기 위한 과제를 점검한 다음, 기본소득이 통합을 달성하는데 이바지할 수 있는 가능성과 그 한계에 대해 고찰한다. 기본소득은 소득이나 자산에 대한 평가, 근로 여부에 대한 심사를 하지 않고, 개인을 단위로 하여 모든 구성원에게 정기적으로 지급되는 현금을 의미한다. 정기성, 현금지급성, 개별성, 보편성, 무조건성을 개념적 징표로 하며, 이러한 특징이 유지되는 범위에서 구체적인 제도화의 형태는 다양하게 나타날 수 있다. 한편, 국가는 통합에 기초하여 성립과 존속이 가능하다. 사회통합은 정치적 사회경제적 문화적 측면의 동질성을 의미하는 것으로서 이는 헌법이 기능하기 위한 전제조건이 된다. 헌법은 이러한 동질성의 확보를 국가의 과제로 삼으며, 오늘날 분열과 양극화를 방지하고 정치적, 사회경제적, 문화적 영역에서 통합을 도모하기 위한 많은 규정들을 담고 있다. 기본소득은 모든 구성원이 시민의 지위를 실질적으로 향유하며 민주주의적 논의와 공적 과제의 해결 과정에 자율적이고 능동적으로 참여할 수 있는 조건을 제공함으로써 정치적 통합에 기여할 수 있다. 또한 기본소득은 재분배를 통한 사회경제적 통합을 추구한다는 점에서 기존의 복지제도와 유사할 뿐 아니라 보편성과 무조건성으로 인하여 사회통합의 관점에서 보다 특별한 의미를 부여받을 수 있다. 나아가 일자리 나눔, 노동과 자본의 불균형 완화, 성별에 따른 차별의 해소에도 긍정적으로 작용함으로써 사회경제적 통합에 기여할 수 있다. 이밖에도 기본소득은 공동체의 모든 구성원들이 자신의 선호에 따라 정신적 가치의 창조에 이바지하거나 공동체의 문화적 발전과 통합을 위한 다양한 활동에 참여하도록 하는 동력이 될 수 있다. 문화의 창조 및 향유를 가능하게 하는 물질적 지원, 관심에 따른 모임과 소통, 교류를 통해 공동체 구성원들이 문화를 공유할 수 있는 기회를 확대함으로써 문화적 통합에 기여할 수 있는 것이다. 다만, 이처럼 기본소득이 정치적, 사회경제적, 문화적 통합에 기여할 수 있는 가능성은 이론적 차원에서 기본소득의 효과에 대한 긍정적 전망을 전제로 한 것이다. 기본소득은 기존의 복지제도와 구분되는 혁신적인 성격을 갖고 있으며, 막대한 재원이 소요되고, 다양한 방식으로 제도화될 수 있다. 그만큼 도입에 대한 정치적 사회적 합의를 도출하는 것이 쉽지 않고 그 과정에서 상당한 갈등이 야기될 수 있다. 또한 기본소득 도입에 따른 효과 역시 상당한 논쟁의 대상으로서 검증이 쉽지 않고 따라서 기본소득이 정치적 사회경제적 문화적 통합에 미치는 영향력을 단정할 수도 없다. 기본소득의 의미와 가능성은 다양한 관점에서 충분히 검토되어야 하며, 사회통합과 관련해서도 기본소득이 통합을 위한 새로운 대안이 될 수 있는지, 그러한 가능성은 과연 어떠한 조건에서 발휘될 수 있는지에 대한 연구가 계속될 필요가 있다.

영문 초록

Social integration is a condition for forming constitution, that is, the driving force that constitutes a state, and a condition for the constitution to function properly. This thesis examines the potential and limitations of basic income to realize the social integration. After examining the meaning of basic income, the constitutional significance of social integration and the tasks for realizing integration in the political, socio-economic and cultural spheres are reviewed. It also examines the potential and limitations of basic income that can contribute to achieving integration. First, basic income can contribute to political integration by providing conditions for all members to substantially enjoy the status of citizens and to participate autonomously and actively in the process of democratic discussions and solving public issues. Next, basic income is similar to the existing welfare system in that it pursues socio-economic integration through redistribution, and it can be given a more special meaning interms of social integration due to its universality and unconditionality. In addition, it can contribute to socio-economic integration by working positively in job sharing, easing the imbalance between labor and capital, and resolving gender discrimination. Finally, basic income can serve as a driving force for all members of the community to contribute to the creation of spiritual values according to their preferences or to participate in various activities for the cultural development and integration of the community. It is possible to contribute to cultural integration by expanding opportunities for community members to share culture through material support that enables the creation and enjoyment of culture, gatherings, communication, and mutual exchanges based on interest. However, the possibility that basic income can contribute to political, socio-economic, and cultural integration as described above is based on a positive outlook on the effect of basic income on a theoretical level. Basic income is innovative that is distinct from the existing welfare system, requires enormous financial resources, and can be institutionalized in various ways. As such, it is not easy to come up with a political and social consensus on introduction, and considerable conflict can arise in the process. In addition, the effect of basic income is also subject to considerable debate, and it is not easy to verify, and therefore, it is not possible to determine the influence of basic income on social integration. The meaning and possibility of basic income should be thoroughly reviewed from various perspectives, and from the perspective of social integration, research needs to be continued on whether basic income can be a new alternative for integration and under what conditions such an effect can be realized.
