노인보호의 헌법적 근거와 노후소득보장의 체계

국문 초록

사람이 늙어가는 것은 자연현상이다. 인간의 수명이 길어진 것은 한편으로 과학의료기술의 발달로 얻은 축복이지만, 다른 한편으로 노후의 삶이 인간답게 유지될 수 있을 것인가에 대한 현실적 난제를 몰고 오기도 한다. 법학을 비롯한 다양한 학문분야의 연구자들은 노인의 문제를 다각도로 분석하고 이를 바탕으로 노인과 관련된 현실의 문제를 풀어가고 규범화작업도 진행하여 왔다. 이 글은 헌법에 나타난 노인보호에 대한 규범적 함의를 해석하고, 그 보호규범들에 대한 체계적 이해를 위한 논의를 발전시켰다. 노인에 대한 헌법적 근거가 다른 외국 입법례와 비교하여 다소 상세하게 규정되었고, 이들 규정은 여러 사회보장적 입법에 대한 방향과 그 한계를 제시해 준다. 노인비율은 사회에서 증가하고 있고, 입법자는 최소한의 소득보장과 건강유지에 대한 법정책을 개발하고 있다. 다만 이들 사회보장 관련 입법은 국가의 재정능력과 연계성을 지니므로 국민이 기대하는 만큼 빠른 속도로 개선이 이루어지지 못하는 면도 있다. 이 글은 현행 노인 관련 입법의 현황을 분석하여 그 제도의 미비점을 찾고, 향후 초고령사회를 대비하여 노인의 소득보장, 근로의 보호 그리고 건강의 문제들을 연관지어 검토하고 있다. 요컨대 노인은 개별자산에 더하여 기초생활보장급여(공적부조), 기초연금, 공적연금, 사적연금 및 노동을 통한 소득으로 노후의 삶을 영위한다. 노인의 소득보장은 사회연대의 원리에 기초하여 인간다운 생활이 보장될 수 있는 출발이며, 사회통합의 중요한 요소이다.

영문 초록

Human aging is natural. The increase in life expectancy is a blessing from the development of scientific and medical technology. On the other hand, it is a realistic question whether life in old age can be maintained at an appropriate Basic Standard of Human Life level. Researchers in various fields of study, including law, analyzed the problems of the elderly in various ways. Based on this, scholars have solved the problems of reality related to the elderly and have been working on normativization. This study interpreted the normative implications of the protection of the elderly in the Constitution and discussed the reasonable understanding of the protection norms. In the Korean Constitution, legal grounds for the elderly were defined in more detail compared to other foreign legislative practices, and these regulations provide directions and limitations for various social security legislation. The proportion of the elderly is increasing in society, and legislators are developing policies for ensuring minimum income and maintaining health. However, since these social security-related legislation are linked to the fiscal capacity of a state, there are some aspects that cannot be improved as quickly as people expect. This study analyzes the current state of legislation related to the elderly, finds deficiencies in the system, and examines the issues of income security, protection of work, and health of the elderly in preparation for a future super-aged society. In short, the elderly live their old lives with basic living security benefits (public aid), basic pension, public pension, private pension, and income through labor in addition to individual assets. Income security for the elderly is a starting point where human life can be guaranteed based on the principles of social solidarity, and is an important factor in social integration.
