국문 초록

이 연구는 ‘재중(在中)탈북자’의 국적문제와 인권보장에 대한 문제를 구체적 사례를 적시하여 현재 대한민국의 탈북자 관련 법률에 보완할 점은 없는지를 분석하였다. 탈북자들이 법의 흠결을 이유로 대한민국 국민으로서의 권리를 인정받지 못하거나 스스로 원하지 않는 삶을 강요당하는 불행을 방지하기 위한 연구이다. 따라서 이 연구는 탈북자를 포용하는 우리 대한민국의 진정한 사회통합과 더 나아가 남북한의 평화통일 달성에 문제가 되는 규범적인 걸림돌을 제거하는 데에 궁극적인 목적이 있다. 중국 등 제3국에 체류하고 있는 재외탈북자 수는 조사에 따라 10만 명에서 40여만 명까지 추산되고 있다. 탈북자 중에서 대한민국에 입국하여 현재 거주하고 있는 북한이탈주민의 숫자는 이미 3만 여명을 넘어섰다. 이들의 존재는 흔히 ‘먼저 온 통일’이라고 일컬어지고 있으며 한반도의 통일이 현재 진행형임을 알려주는 중요한 징표이기도 하다. 우리 정부가 탈북자 중에서도 북한이탈주민을 위한 보호 및 정착지원체계를 구축하고 있지만, 아직도 이들의 사회적응을 위해 법제도적으로 정비해야 할 문제는 많다. 이와 관련하여 우리 헌법과 국적법이 탈북자의 국적과 관련하여 아무런 보호규정을 두지 않고 있음은 문제의 소지가 있다. 북한을 탈출하여 중국을 비롯한 제3국을 떠돌고 있는 탈북자의 인권을 보호하기 위하여 미비된 제도는 개선되어야 한다. 일반적으로 탈북자의 국적문제와 함께 이들이 국내에 입국하는 과정에서 발생하는 국적취득과 관련하여 발생하는 파생적인 법률문제 등은 당장 탈북자의 인권문제로서 그 법적·제도적 해결방안의 검토는 궁극적으로 남북의 통합과 통일문제와도 연관되는 과제이다. ‘재중(在中)탈북자’의 국적문제는 선행연구자들이 지적하였듯이 현행 법령상의 미비점에 기인하며, 당사자의 의사와는 달리 대법원은 엄격한 의미의 영토조항의 규범성을 유지하려는 의도에서 관련법령을 기계적으로 적용하여 ‘재중(在中)탈북자’가 법적 보호를 제대로 받지 못하는 사례가 많이 발생하고 있다. 그렇다고 하여 현행 헌법상 통일관련 조항의 규범성을 쉽게 부정하지도 못하는 현실적인 한계가 존재한다. 본질적으로는 남북관계의 법적 성격에 대한 논의와 함께 북한의 국가성의 인정여부와 관련하여서도 대법원 판례는 일관성이 없다. 실제로 남북관계의 전례를 보면, 북한에 대한 국가승인을 부정하는 사례와 일부 국가성을 인정하는 사례가 중첩적으로 나타나기도 하였다. 그러나 북한주민의 법적지위 인정문제는 현행헌법상 영토조항을 적용하여 북한지역을 대한민국의 영토로 보고, 이로부터 북한주민을 대한민국 국민으로서의 지위를 인정하는 바탕에서 다루어져 왔다. 그리하여 ‘재중(在中)탈북자’의 국적문제가 발생하게 된다. 이러한 문제점을 원천적으로 해결하기 위해서는 북한주민의 법적지위에 관한 헌법규범과 헌법현실의 불일치현상을 해소하는 것이 필요하다. 이를 위해서는 헌법개정문제로 공론화하여 국민적 합의를 도출하기 위하여 통일정책과 관련하여 논의할 필요가 있다. 개헌을 통하여 헌법규범과 헌법현실의 부조화 현상을 보다 근본적으로 해결하여야 하지만 이는 현실적으로 그리 쉬운 문제가 아니다. 따라서 ‘재중(在中)탈북자’의 국적문제를 해결하기 위하여 보다 현실적인 보호방안을 찾기 위해서는 정책적 개선방법을 찾는 노력과 함께 현행 국적법이나 북한이탈주민법에 북한주민의 국적에 관하여 명확한 근거규정을 두어 재 ‘중(在中)탈북자’의 국적문제를 근본적으로 해결하는 것이 보다 바람직하다.

영문 초록

This study analyzes the problem of nationality of North Korean defectors in China and the issue of guaranteeing human rights by analyzing whether there is any point that can complement the current North Korean defectors law. We want to reduce the misfortune of North Korean defectors who are forced to live their lives because they are not recognized as a citizen of the Republic of Korea or because they are deficient in law. Therefore, this study has the ultimate purpose of eliminating the normative obstacles that are the problem of the true social integration of the Republic of Korea and the achievement of peaceful reunification of the two Koreas. The number of overseas defectors who are staying in third countries such as China is estimated to be 100,000 to 400,000 according to the survey. The number of North Korean defectors who have entered the Republic of Korea and currently reside in Korea has already exceeded 30,000. Their existence is often referred to as “early completed unification” and is also an important indicator that the reunification of the Korean Peninsula is ongoing. Although our government has established a protection and settlement support system for North Korean defectors, there are still many problems that need to be regulated systematically for their social adjustment. In this regard, there is a problem that our Constitution and the Nationality Law do not provide any protection provisions regarding the nationality of defectors. In order to escape from North Korea and protect the human rights of North Korean defectors who are wandering around China and other countries, the system that is lacking should be improved. In general, the issue of nationality of defectors and the derivative legal issues arising from their acquisition of nationality in the process of their entry into the country are the human rights issues of North Korean defectors immediately, and the review of the legal and institutional solutions will ultimately lead to the integration of the two Koreas. The issue of nationality of defectors in Korea is due to the lack of current legislation as pointed out by the previous researchers. Unlike the wills of the parties, the Supreme Court has mechanically applied the relevant laws and regulations in order to maintain the norms of the strict territorial clauses (Constitution Article 3). There are many cases where legal protection is not properly received. However, there is a realistic limit that can not easily deny the normality of the provisions related to unification under the current Constitution. In essence, the Supreme Court precedents are inconsistent with regard to the legal nature of inter-Korean relations and the recognition of North Korea s nationality. Indeed, in the precedent of inter-Korean relations, there have been overlapping examples of denying the North s national approval and acknowledging some nationalities. However, the issue of recognizing the legal status of North Korean residents has been dealt with on the basis of recognizing North Korea as a territory of the Republic of Korea by applying territorial clauses under the current Constitution and recognizing the status of North Koreans as Korean citizens. Thus, the issue of nationality of North Korean defectors will arise. In order to solve these problems, it is necessary to resolve the inconsistency between the constitutional norms and the constitutional reality concerning the legal status of the North Korean people. For this purpose, it is necessary to discuss the unification policy in order to publicize it as a constitutional amendment issue and draw national consensus. The constitutional norms and the constitutional reality must be solved more fundamentally through the amendment, but this is not an easy problem in reality. Therefore, in order to solve the problem of nationality of North Korean defectors in China, a more realistic protection measures are to find ways to improve the policy,
