국문 초록

경찰이 ‘회복적 경찰활동’(restorative policing)을 선언하고 활발하게 활동하고 있다. 범죄예방을 위한 직접 수행하는 기관으로서 경찰활동의 역할과 기능은 회복적 정의에 바탕을 둔 활동과도 상당 부분 겹친다. 그러나 가치적인 관점에서 경찰활동과 회복적 정의는 조화로운가? 실천적인 측면에서 회복적 경찰활동을 살펴보면, 수사절차의 하나, 즉 또 다른 전형적인 형사절차는 아닐까? 누가 (회복적) 절차에 관여해야 하는가에 대해서는 여전히 논란이다. 그러나 국가기관과 공식적인 틀을 벗어나 비정형성이 회복적 정의의 ‘정형’이어야 한다는 생각이다. 관점에 따라 ‘정의’에 대한 생각도 달라진다. 응보의 정의에 바탕을 둔 형사사법의 절차 진행과 회복적 정의를 꾀하는 절차 운영에는 차이가 있다. 일방적인, 획일적인, 단편적인 형사사법과 그 구성원이 비정형성, 자율성이 요구되는 절차에 관여하는 것이 얼마큼 가능하겠는가에 대한 회의가 있었다. 이름짓기(naming)는 가리키는 대상을 규정해버린다. 즉, 명칭이 사건의 성질과 제도의 성격을 정한다. 따라서 회복적 경찰활동의 운영을 살펴보면서, 회복적 정의의 의미와 회복적 경찰활동의 방향을 집어보는 것으로 의미를 찾겠다.

영문 초록

Police have declared “restorative police activities” and are active. The role and function of police activities as a direct institution for crime prevention overlaps much with activities based on restorative justice. But from a value perspective, is police activity harmonious with restorative justice? In practical terms, isn t it one of the investigative procedures, another typical criminal procedure? It is still controversial who should be involved in the (recoverable) process. However, the idea is that non-formality should be a ‘regular’ of restorative justice outside the formal framework of state agencies. Depending on the perspective, the idea of justice also changes. There is a difference between the proceedings of criminal justice based on the definition of retribution and the operation of procedures to seek restorative justice. There was a skepticism about one-sided, uniform, fragmented criminal justice and how much it would be possible for its members to engage in procedures that require unformity and autonomy. Naming defines the object to which it is pointed. That is, the name determines the nature of the event and the nature of the system. Therefore, we will find meaning by looking at the operation of resilient police activities and by looking at the meaning of restorative justice and the direction of restorative police activities.
