범죄피해자구조 및 경제적 지원에 관한 관점의 변화

국문 초록

2005년 범죄피해자보호법의 제정으로 인하여 국가는 가해자중심적 국가형벌권 행사의 관점에서 탈피하여 범죄피해자중심적 보호와 지원을 목적으로 하는 법・제도적 운용을 통하여 범죄피해자의 사회복귀 및 법적 안정성 회복에 주력하여 왔다. 이는 단순한 시혜적 차원이 아니라, 범죄피해자는 국가의 사회보장의무와 범죄예방의무 및 국가형벌권을 통한 진실발견의무를 통하여 국가의 조력을 받아야 할 권리를 부여받는다. 범죄피해자보호법은 이와 같은 국가 의무의 이행을 구체화하기 위하여 5년마다 범죄피해자 보호지원 기본계획의 수립을 요청하였고, 이미 2007년 제1차 기본계획을 시작으로 하여 2021년에는 제3차 기본계획이 종료하게 된다. 그리고 2021년 제3차 기본계획이 종료함에 따라 제4차 기본계획의 수립이 요청되는 시점이다. 따라서 향후 5년간 범죄피해자보호지원과 관련한 법적・제도적 기틀이 될 기본계획의 방향과 정책목표의 수립에 필요한 사항들의 진단이 우선되어야 할 것이다. 범죄피해자보호법이 제정된 2005년 이후 법적・제도적 개선은 물론 그와 관련된 이론과 연구도 매우 방대하게 축적되어 왔다. 또한 3차에 걸친 기본계획의 수립과 이행과정에서 의미있는 성과도 물론 많았지만 구조적인 미비점과 미이행된 계획들 역시 숙제로 남게 되었다. 따라서 제4차 기본계획의 수립은 기존의 계획들과 분리된 독자적인 것이 아니라, 기이행 과제의 진단과 미이행과제의 점검을 통해 15년간 범죄피해자기본계획이 추진하여온 13개의 정책영역과 36개의 정책과제들의 진단이 우선되어야 할 것이다. 그동안 범죄피해자보호기금을 수립하고 막대한 인적・물적 경비를 투입한 결과를 검토하고 그 추진과정과 관련문제들에 관한 성찰을 토대로 함은 물론, 이와 관련하여 이루어진 많은 연구와 도입된 이론들이 제안하는 방안들을 수용하여야 할 것이다. 여기에서는 범죄피해자보호지원과 관련하여 범죄피해자구조금을 비롯한 경제적 지원분야에 한정하여 그간의 기본계획들의 구조를 비교하고, 제4차 기본계획의 방향에 관하여 시론적으로 살펴보고자 한다. 이를 위해 우선 제4차 기본계획 중 국가의 경제적 지원과 관련하여 기본적인 접근방향을 살펴보고(Ⅱ), 제1, 2차 기본계획의 분석을 바탕으로 제3차 기본계획의 기본틀과 그 결과를 확인한 후에(Ⅲ), 제4차 기본계획의 방향을 시론적으로 제시해 보고자 한다(Ⅳ).

영문 초록

With the enactment of the Crime Victims Protection Act in 2005, the state has strengthened the system for the purpose of protecting and supporting crime victims rather than the view of exercising the right of national punishment. This does not simply provide benefits, but it means that crime victims have the right to receive assistance from the state through the state s social security obligations, crime prevention obligations, and the state s obligation to discover truth through the state s penal rights. The State and local governments shall formulate plans necessary to provide counselling, medical services (including medical expense subsidization), relief funds, legal aid, employment assistance, and dwelling support, and other plans necessary for protecting crime victims, proportionate to the degree of harm suffered by crime victims and to the necessity for protection and support. The Crime Victims Protection Act requested the establishment of a basic plan for protection of crime victims every five years in order to materialize the fulfillment of such national obligations(master plan for protection and support for crime victims, Crime Victim Protection Act § 12). As the 3rd basic plan in 2021 is finished, it is the time when the establishment of the 4th basic plan is requested. Therefore, the direction of the basic plan, which will be the legal and institutional basis for the protection support for crime victims for the next five years, and the diagnosis of matters necessary for the establishment of policy goals should be given priority. Since 2005, when the Crime Victim Protection Act was enacted, not only the improvement of laws and institutions, but also a lot of related theories and studies have been accumulated. In addition, there were significant achievements in the process of establishing and implementing the 3rd basic plan, but there were plans that were not achieved. Therefore, it is necessary to determine whether the 4th basic plan for the protection of victims of crime will include plans that have not been achieved. In addition, problems such as improvement of crime victim relief funds, protection of foreign victims, long-term support, integrated support, and indirect protection of victims should be solved.
