국문 초록

가정폭력은 가정폭력에 대응하는 다양한 정책이 수립・시행되고 있음에도 우리 사회에서 여전히 해결해야 할 심각한 사회문제로 제기되고 있다. 이는 가정폭력에 영향을 미치는 요인들이 매우 다양한 차원에서 복합적으로 작용하고 있어 어느 한 기관이 가정폭력에 대응한다고 하여 가정폭력을 예방할 수 없기 때문이다. 이에 가정폭력에 효율적으로 대응하기 위해서는 국가 및 지방자치단체, 사법기관, 가정폭력 관련 전문기관들이 서로 협업체계를 구축하여야 한다. 그러나 이러한 협업체계는 지역별 예산, 인력, 가정폭력 관련 상담소・보호시설 등 인프라의 차이로 서로 다른 형태로 운영될 수밖에 없으며, 실제로 각 지역의 협업체계는 지역별 특성을 고려한 형태로 운영되고 있다. 우리나라의 경우 각 지역별로 서로 다른 형태의 협업체계를 운영하고 있으며, 이는 피해자가 지역을 이전하는 경우 피해자에 대한 보호・지원서비스가 서로 달라서 서비스가 연계되지 않거나 피해자에게 적절한 보호・지원이 이루어지지 않는 문제가 발생하기도 한다. 이에 가정폭력에 대응하기 위해 운영되고 있는 다기관의 역할을 조정하고, 유기적인 연계를 주도하는 기관을 설정하여 각 지역에서 제공하는 피해자 보호・지원 서비스의 양적・질적 관리가 필요하다. 우리나라 법체계를 고려하여 지방자치단체를 중심으로 경찰 등 사법기관과 가정폭력 관련 전문기관들이 연계하여 경찰 등 사법기관은 가해자에 대한 수사와 처우에 집중하면서 각 지역별 전문기관과 협력하여 피해자 보호・지원정책을 수립・운영해야 할 것이다. 각 기관이 서로 유기적으로 연계하여 가정폭력에 효율적으로 대응하기 위해서는 가정폭력사건 및 피해자에 대한 정보도 공유되어야 할 것이다. 그러나 정보공유는 가정폭력에 효율적으로 대응할 수 있는 요건이 될 수 있지만, 피해자의 개인정보를 실수로 또는 무단으로 유출하는 경우 피해자에게 중대한 침해를 발생하게 할 수도 있기 때문에 정보의 안전을 보호할 수 있는 장치가 함께 마련되어야 한다.

영문 초록

Domestic violence is still being raised as a serious social problem to be solved in our society, even though various policies to respond to domestic violence have been established and implemented. This is because the factors affecting domestic violence are working in a wide variety of dimensions, and domestic violence cannot be prevented just because one organization responds to it. Accordingly, in order to effectively respond to domestic violence, the state and local governments, judicial institutions, and domestic violence-related specialized agencies must establish a cooperative system with each other. However, these collaboration systems are inevitably operated in different forms due to differences in infrastructure such as regional budgets, manpower, and domestic violence-related counseling centers and protection facilities. In Korea, different types of collaboration systems are operated for each region, and this means that when the victim relocates, the protection and support services for the victim are different, so the service is not linked or adequate protection and support are not provided to the victim. In order to respond to domestic violence, it is necessary to adjust the roles of multi-centers in operation, establish organizations that lead organic links, and manage the quantity and quality of victim protection and support services provided in each region. In consideration of the Korean legal system, judicial institutions such as the police and domestic violence-related specialized agencies are linked with local governments as the center, and judicial organizations such as the police focus on investigation and treatment of perpetrators, while cooperating with specialized agencies in each region to protect and support victims. Should be established and operated. Information on domestic violence incidents and victims should also be shared in order for each agency to effectively respond to domestic violence by linking with each other organically. However, information sharing can be a requirement to effectively respond to domestic violence, but if the victim s personal information is accidentally or without permission, it may cause serious infringement to the victim, so a device that can protect the safety of information.
