판단자의 성 역할 고정관념과 피고인의 성별이 배우자 보험살인 사건 처벌판단에 미치는 영향

국문 초록

배우자 살인에 관한 선행연구는 주로 범행 동기의 유형을 분류하거나 판결문 상에 나타난 가정폭력 피학대 여성의 양형 요인이나 심리상태에 초점을 맞추었다. 그러나 금전적 이익을 목적으로 배우자 살해를 저지른 혐의를 받는 피고인에 대한 처벌판단에 영향을 미치는 요인을 알아본 연구는 드물다. 따라서 본 연구는 연구 참가자의 성별과 성 역할 고정관념의 수준이 배우자 보험살인 사건의 처벌판단에 어떤 영향을 미치는지 알아보고자 하였다. 이를 위하여 배심원의 자격을 충족하는 208명의 연구 참가자를 대상으로 성 역할 고정관념을 측정하고 보험살인 사건에 대한 처벌판단을 내리도록 했다. 연구 결과, 첫째, 남성 참가자는 여성 참가자보다 성 역할 고정관념이 더 높은 것으로 나타났다. 둘째, 피고인의 성별과 처벌 유형 간에는 유의한 연관이 나타나지 않았다. 셋째, 남성 참가자는 남성 피고인보다 여성 피고인에게 더 무거운 처벌을 내려야 한다고 생각했고, 더 긴 양형을 부과하였다. 여성 참가자는 여성 피고인보다 남성 피고인에게 더 무거운 처벌을 내려야 한다고 생각했고, 더 긴 양형을 부과하였다. 그러나 성 역할 고정관념은 처벌판단에 미미한 영향을 미쳤다. 이러한 결과는 연구 참가자의 성별과 피고인의 성별이 배우자 보험살인 사건에 대한 처벌판단에 유의한 영향을 미치는 요소로 작용할 수 있음을 의미한다. 마지막으로 본 연구의 의의와 제한점을 논의하였다.

영문 초록

Previous studies mainly examined spouse homicide offenses on classifying the types of motivation, sentencing factors, or psychological state of female domestic violence victims in court rulings. However, it is rare to find research studies that investigated the factors affecting the punitive judgments for a defendant accused of spouse homicide for financial gain. The purpose of this study is to investigate how gender and gender role stereotypes of mock jurors influence punitive judgments in a spouse insurance homicide offense. Total of 208 juror-eligible participants participated for the study. First, the results showed that male participants have higher gender role stereotypes than female participants and the high gender role stereotype group judged that the defendants should be punished more severely, and gave higher sentences than the low gender role stereotype group. Second, there was no significant relation between gender of defendants and type of punishment. Third, male participants judged that the female defendant should be punished more severely and gave higher sentences than the male defendant. Furthermore, female participants judged that the male defendant should be punished more severely, and gave higher sentences than the male defendant. But the effect of gender role stereotypes was small. The results suggest that gender of mock jurors and defendants could operate as important factors for punitive judgments in spouse insurance homicide cases. The implications and limitations of the study were also discussed.
