공동주택관리법개정과 경비업법 적용

국문 초록

공동주택관리 경비원의 관리업무 개선방안에 대한 그동안의 논의에도 불구하고, 정부는｢공동주택관리법｣제65조의 2를 신설하여, 동조 제1항은 공동주택에 경비원을 배치한 경비업자는 경비업법 제7조제5항에도 불구하고 대통령령으로 정하는 공동주택 관리에 필요한 업무에 경비원을 종사하게 할 수 있다.라고 하여 경비업자가 고용한 공동주택 경비원의 업무를 확대한다. 동조 규정의 내용은 공동주택관리 경비원의 경비업무는 경비업법 소정의 업무를 수행한다는 전제로 ① 경비업법에 의하여 등록한 경비업자가 고용한 경비원에 적용토록 하고, ② 확대되는 업무범위를 대통령령으로 정하도록 한다. 이와 같은 신설 규정에 대하여, 필자는 과연 공동주택관리법의 동조 신설로서 경비업법 제7조 제5항의 적용을 배제하는 효력을 가지는 가 의문이 제기된다. 또한, 동조 적용에 있어서도 ① 공동주택관리 경비원의 경비업무를 경비업법 소정의 업무를 수행한다는 전제로 하나 공동주택관리 경비로서 단지 안의 안내, 순찰은 주민생활관리업무의 일환으로 한다는 점, ② 경비업법 등록에 의하지 아니한 경비업자 고용의 경비원에는 적용이 배척되는 점, ③ 동조 적용을 받는 공동주택관리 경비원은 경비업무 외에 경비업법 규제에 대하여는 적용을 받는다는 점 등에서 문제가 제기된다. 무엇보다 동조 신설의 이유로서 경비원이 경비업무외 업무를 병행하고 있는 현실을 반영하기 위한 것이라고 하지만 공동주택 관리현장에서 경비원은 대다수가 고령인 점을 고려하면 ｢경비업법｣ 소정의 자격 및 장비를 갖추어｢경비업법｣상 경비업무로서 도난･화재 그 밖의 혼잡 등으로 인한 위험발생 방지업무의 집행이 능력이 없는 점도 고려한 것인지 의문이 제기한다. 그리하여 본고에서는, 공동주택관리를 위한 경비원의 경비업무에 ｢경비업법｣적용의 논란의 여지를 없애기 위한 제안으로｢공동주택관리법｣제63조를 개정하여 ‘공동주택 단지안의 ‘경비’를 삭제하고 관리업무의 내용을 명확히 할 필요가 있음을 제기하였다.

영문 초록

Despite previous discussions on how to improve the management work of the security guards for apartment management, the government newly established Article 65-2 of the Apartment Management Act, and paragraph 1 of the same article refers to the security business law, Article 7 Notwithstanding paragraph (5), the duties of security guards for apartment houses hired by security companies will be expanded by saying that security guards may be engaged in duties necessary for the management of apartment houses prescribed by Presidential Decree. The contents of the provisions of this Article shall be applied to the security guards employed by the security service provider registered under the Security Business Act on the premise that the security service of the apartment management security guard performs the duties prescribed by the Security Business Act, and ② the scope of the expanded work shall be determined by Presidential Decree. Regarding these new regulations, it is questioned whether the new establishment of the Apartment House Management Act has the effect of excluding the application of Article 7 (5) of the Security Business Act. In addition, in the application of the same article, ① on the premise that the security service of the apartment house management guard performs the duties prescribed by the Security Business Act, but the guidance and patrol in the complex as an apartment management expense is part of the residents life management work. ② Registration of the Security Business Act Problems arise from the fact that the application is excluded to security guards who are hired by a security company that is not in accordance with the same rule, and that the security guards for apartment management who are subject to the same agreement are subject to the regulations of the Security Business Act in addition to the security business. Above all, the reason for the establishment of the Dongjo is to reflect the reality that security guards are doing business other than security work, but considering that the majority of security guards at the apartment management site are elderly, they have the qualifications and equipment prescribed in the ｢Security Industry Act｣ According to the Security Business Act”, a question arises whether the execution of the risk prevention business due to theft, fire, or other congestion takes into account the inability to execute. Therefore, in this paper, as a proposal to eliminate controversy over the application of the ｢Security Business Act｣ to the security affairs of security guards for the management of apartment houses, Article 63 of the ｢Public Housing Management Act｣ was amended to delete and manage the expenses in the apartment complex. They raised the need to clarify the content of the work.
