국문 초록

본고에서는 지식재산(IPR) 부문과 관련한 EU의 최근 동향 및 전략을 연구하였다. 구체적으로 IPR 분야에서 EU의 선도적 규범 영역으로 자리매김한 지리적표시제에 관해 고찰하였으며, EU가 지리적표시제를 포함한 IPR 분야의 정책 전략을 통일성, 단일화, 현대화하고 있음을 분석하였다. 그리고 양자 및 다자 간 통상협상을 통한 규범 확대에 초점을 맞추고 있음을 분석하였다. 이러한 정책 전략을 통해 유럽연합 내부 단일시장 지리적표시제의 통일화, 영역 및 규범의 확장, FTA 등을 통한 국제 규범 확대를 추진하고 있는데 반해 한국 내에서는 지리적표시제의 영향력 확대 혹은 제도의 정비가 제대로 진행되지 못하고 있는 실정이다. 제도를 통해 국가 이익을 추구하고자 한다면 정부는 현재 지리적표시제의 이중 관리 체제를 단일화하여야 하며, 소비자 인식 확대를 통해 지리적표시 농수산물, 임산물 나아가 비농산 영역 전통문화산업 지리적표시제까지의 확대를 지향할 수 있을 것이다. 한국의 지리적표시제는 도입된 지 15년 정도가 경과하였으나, 현재까지 제도적 정비 과정 중에 있으며, 이러한 정책 혼선 속에 소비자 인식 정도가 낮은 상태에 머물러 있는 것으로 나타났다. 지리적표시제와 같은 사회규범은 내부시장에서의 단일화한 정책 방향상이 주요하며, 이와 같은 전략적 자세가 제도의 국가경쟁력을 제고할 수 있음을 고려해야 한다.

영문 초록

This paper explains recent trends and strategies of the EU regarding the Intellectual Property Rights(IPR) sector, in particular, the geographical indication(GI) system which has become the leading normative area of community in IPR field. It is analyzed that the community is unifying, unifying and modernizing the policy strategy in the IPR field including the geographical indication. And that the GI strategy of the community focuses on expanding norms through bilateral and multilateral trade negotiations. Through these policy strategies, the European Union is promoting the unification of internal single-market geographical indication systems, expansion of territory and norms, and expansion of international norms through the conclusion of FTAs. On the other hand, the Korean government is not able to expand the influence of the geographical indication system or to improve the system. If the government wishes to pursue national interests through the system, the Korean government should unify GI’s dual management system and promote expansion of GI agricultural and marine products, forest products, and non - agricultural GI.It has been about 15 years since the introduction of the Korean geographical indication system, but so far it has been undergoing institutional maintenance. So consumer perceptions remain low in this policy mix in Korea. Since social norms such as GI are central to the unified policy direction in the internal market, governments should consider that strategy can enhance the national competitiveness of the system.
