국문 초록

동북아 주변국가들의 한반도 평화체제 구축에 대한 입장을 보면 한국과 미국은 ‘선 핵폐기, 후 평화협정’을, 북한은 ‘선 평화협정, 후 핵폐기’를, 중국은 ‘병행추진론’을 주장하고 있다. 평화협정의 체결 유형과 속성을 볼 때 하나의 공식적인 평화협정으로 분쟁이 종결되기보다는 이를 해결하는 과정에서 수많은 협정들이 체결될 수 있다. 이에 평화협정을 체결 당시의 상황과 조건에 따라 예비적 기초협정, 실질적 기본협정, 보완적 이행협정으로 유형화할 수 있다. ‘선 핵폐기, 후 평화협정’을 보면, 예비적 기초협정에서는 북한의 핵관련 모든 시설이 폐기되는 절차에 합의한다. 실질적 기본협정에서는 핵폐기를 확인하고 포괄적인 형태의 한반도 평화협정이 체결되며, 보완적 이행협정에서는 북한 핵폐기의 이행과 검증 절차에 합의하고 한반도의 평화정착을 위한 각종 후속 사안을 합의하게 된다. ‘선 평화협정, 후 핵폐기’를 보면, 예비적 기초협정에서는 정치⋅군사적 신뢰구축과 북미 관계정상화 등의 합의와 함께 북한의 핵폐기 의지를 확인하게 된다. 실질적 기본협정에서는 북핵폐기 절차에 합의하여 한반도 평화협정을 체결하고, 보완적 이행협정에서는 북핵폐기에 대한 제반 이행사항에 대해 합의한다. ‘병행추진론’을 보면, 예비적 기초협정에서는 관련국 간 비핵화와 평화협정의 병행추진에 합의하고, 북한의 핵시설 동결과 한미군사훈련 폐지를 맞교환할 수 있다. 실질적 기본협정에서는 북핵폐기와 한반도평화협정 체결을 동시 병행 추진하는 합의를 하게 되며, 보완적 이행협정에서는 실질적 기본협정의 합의사항에 대한 이행사항을 점검하고 보완하는 합의를 한다.

영문 초록

The respective positions of key Northeast Asian actors regarding the construction of a peace system on the Korean peninsula are as follows: South Korea and the United States advocate “denuclearization first, peace agreement second,” North Korea calls for “peace agreement first, denuclearization second,” and China proposes “parallel track” efforts. However, a close examination of the types and characteristics of peace agreements reveals that it is rare for a single formalized agreement to bring an end to conflict. Rather, conflicts are most often resolved through a complicated process involving a constellation of agreements. In view of the surrounding circumstances and conditions, peace agreements can be variously classified as preliminary base agreements, substantive basic agreements, and supplementary implementation agreements. The “denuclearization first, peace agreement second” pathway would involve deactivating all nuclear-related facilities in North Korea through a preliminary base agreement. A substantive basic agreement would then confirm this deactivation and reach a comprehensive peninsula-wide peace agreement. Finally, the parties would use a supplementary implementation agreement to establish the implementation and verification procedures for North Korean denuclearization, as well as to reach agreement on the various follow-on efforts needed to consolidate peace on the peninsula. As for “peace agreement first, denuclearization second,” a preliminary base agreement would involve political and military trust-building and normalization between North Korea and the United States, as well as the confirmation of Pyongyang’s resolve to denuclearize. The substantive basic agreement would then establish the procedures needed for denuclearization and the signing of a peach treaty, and the supplementary implementation agreement would be used to reach consensus on the specific tasks required for denuclearization. Finally, the “parallel track” pathway would first require a preliminary base agreement affirming the parties’ determination to simultaneously pursue denuclearization and peace agreement, and which would perhaps involve a trade-off between a freeze on North Korean nuclear installations and a moratorium on ROK-US military exercises. A substantive basic agreement would then formalize the agreement to implement North Korean denuclearization and a peninsular peace agreement, the specific requirements of which would be verified and amended through a supplementary implementation agreement.
