국문 초록

2003년 이후 우리 사회에서 북한 인권문제와 관련하여 지속적인 논의가 있었음에도 불구하고 국회에서의 법안 통과는 2016년 3월 2일 제19대 국회에서였다. 이는 북한인권법안이 발의된지 11년 만에 이루어진 결과이다. 우리 사회에서 북한인권법이 통과되기까지 오랜 시간이 걸린 것은 북한인권문제가 복합적이고 다차원적으로 고려해야 할 요소가 많기 때문이다. 북한인권법이 통과되기까지 11년이라는 시간이 걸렸듯이 향후 우리 사회에서는 북한인권문제와 관련하여 정책적으로나, 학술적으로도 많은 논쟁이 야기될 것으로 전망된다. 북한 인권문제는 국내외적으로 환경과 구조, 조건 등 고려해야 할 사안이 많이 있다. 북한인권문제와 관련하여 우리 사회에서는 북한인권법의 실효성에 의문을 제기하는 시각과 북한인권법제정으로도 북한체제에 강력한 경고가 될 수 있다는 시각이 공존하고 있다. 따라서 본 논문에서는 북한인권법의 구성과 내용, 특성을 면밀히 고찰하였다. 또한 북한 인권정책의 방향을 구조적, 기능적으로 살펴보았다.

영문 초록

Since 2003, despite continuous discussion by our community regarding North Korea’s human right issues, passage of the bill was achieved only in the 19th National Assembly on March 2nd, 2016. Such breakthrough was made in 11 years after the proposal of North Korean Human Rights Act. The reason why it took a long period of time to pass the bill is that the law is complex and requires a lot of considerations due to the nature of multidimensional aspects. As it took 11 years until the passage of North Korean Human Rights Act, there will be numerous disputes in our society, in terms of policy, or in academic aspects in regards to human rights issues of North Korea in the future. For human rights issue of North Korea, there are a lot of considerations, such as domestic and international environment and structure, condition, and others. Regarding human rights issue of North Korea, two viewpoints exist at the same time that a question is raised about effectiveness of North Korean Human Rights Act, and establishment of North Korean Human Rights Act alone is already a strong warning to the North Korean regime. Therefore, in this thesis, we examined carefully the composition, details, and the feature of North Korean Human Rights Act, in addition to the direction of North Korean human rights policy, in terms of its structure and function.
