수상레저활동 안전관리 개선방안에 관한 연구

국문 초록

국민소득이 향상되면서 일과 건강한 삶의 질이 중요시 되는 워라밸 문화가 확산됨에 따라 수상레저 활동자들도 급속도로 증가하고 있다. 과거에는 낚시어선을 이용한 선상낚시객들이 대부분이었으나, 최근에는 수상레저장비의 구입이 저렴해 지면서 비교적 목돈을 드리지 않고도 레저보트 등을 구입할 수 있게 되었다. 이를 통해 직접 바다에 나가 레저활동을 즐기는 이용자가 매년 급증하고 있으며, 그에 따른 사고도 매년 증가하고 있는 추세이다. 현행 「수상레저안전법」에서 규정하고 있는 수상레저 활동자 중 원거리 활동을 할 경우 통법 제21호 서식에 의해 활동 신고서를 해양경찰관서에 제출해야 한다. 하지만, 근거리 수상레저 활동자의 경우에는 해양경찰 등에 활동에 대한 신고의무가 없다. 더불어, 레저보트의 경우 그 규모가 커지고 있으며, 다중이 승선하여 원거리까지 몇일 동안을 레저활동을 함에도 선박의 위치를 표시하는 장치(V-Pass, VHF DSC, AIS 등)의 의무 규정도 없다. 만약 사고가 발생하였을 경우 해양경찰은 레저보트에 대한 정보의 부재로 골든타임을 자칫 놓치게 되는 문제가 발생한다. 또한, 의무적으로 장착해야 하는 어선, 낚시배 등과의 장비장착에 있어 형평성의 문제가 나타나 이에 따르는 대안을 제시하는데 있다. 따라서, 이 연구에서는 매년 급증하고 있는 수상레저 활동자들의 사고 통계자료를 분석하였다. 이를 통하여 수상레저 활동자들의 사고사례와 원인 등을 살펴보고 문제점과 개선방안을 법·제도적 관점과 실무적 관점으로 나누어 제시하였다.

영문 초록

As the improvement of the national incomes causes the expansion of the work life balance emphasizing the work and the health life quality, the number of water leisure actors is increasing very fast. Most of them were fishermen on the boat for fishing in the past. However, as equipment can be purchased at a comparatively low price recently, a leisure boat can be purchased without a large amount of money. Accordingly, the users enjoying leisure activities directly in the sea are increasing rapidly, and the relevant accidents also tend to increase every year. The short-distance water leisure actor among the water leisure actors specified in the Water-Related Leisure Activities Safety Act has no obligation on reporting to the coast guard agency. However, it is stated that the marine leisure activity report based on the no. 21 form of the same law should be submitted to the coast guard agency in case of a long-distance activity. In particular, in the case of a leisure boat, the size gets larger, and there are no regulations on duty for the device indicating the vessel position(V-Pass, VHF DSC, AIS, etc.) even though multiple people board the vessel and do leisure activities to the long distance for several days. If an accident occurs, the problem with possibly losing the golden response time occurs from the absence of the information on the leisure boat. Furthermore, there is an equity problem with equipment mounting in comparison with the fishing vessel and boat required to mount the equipment so that the alternative need to be proposed accordingly. Therefore, this study analyzed the accident statistics of the water leisure actors increasing every year. The accident cases and causes of water leisure actors were addressed, and the problems and the improvement measures were presented from the perspectives of the law and system and the practice.
