국문 초록

기본적으로 교통사고가 발생했을 때, 형사적 책임은 운전자에게 민사적 책임은 운전자와 운행자에게 있었다. 그러나 자율주행자동차가 개발이 되고 나서는 실질적으로 자동차를 운전하게 되는 것은 자율주행자동차이기 때문에 기존의 교통사고 책임자를 변화해야 한다. 이러한 내용을 근거로 책임 주체에 대해 공법과 사법을 비교하여 자율주행자동차로 인한 교통사고 발생 시 처벌 및 손해배상의 주체에 대해 논의하고자 했다. 사법에서는 이미 법 개정을 통하여 책임의 범위가 더 넓어질 수 있음을 시사했다. 그렇기 때문에 본 논문에서는 운전자에서 책임자로의 변화와 자율주행자동차 제조사의 민‧형사적 책임, 자율주행 기록 장치의 상세한 기준 규정에 대해 검토하였다. 이에 본 논문에서는 사람에게 결함이 있었다면 책임자에게, 자율주행자동차에 결함에 있었다면 자율주행자동차 제조사에게 민‧형사적 책임을 물어야 할 것으로 주장하며, 자율주행 기록장치의 상세한 기준을 규정하여 형사적 책임을 가릴 수 있는 중요한 법적 근거가 될 수 있도록 하여야 한다고 주장한다.

영문 초록

Basically, when a traffic accident occurred, criminal responsibility pertained to the driver and civil liability pertained to the driver and the operating person. However, since it is self-driving cars that actually drive cars after self-driving cars are developed, the existing traffic accident person in responsibility should be changed. Based on this information, it was intended to discuss the subject of punishment and compensation in the event of a traffic accident caused by a self-driving car by comparing the public and private laws. The private law has already suggested that the scope of responsibility can be widened through the revision of the law. Therefore, this paper considered changes from driver to the person in responsibility, civil liability and criminal responsibility of self-driving car manufacturers, and detailed criteria regulations for self-driving recording devices. This paper argues that if a person has a defect, the person in charge should be held civil liability and criminal responsibility and if a self-driving car manufacturer has a defect, the self-driving car manufacturer in charge should be held civil liability and criminal responsibility. Also, The detail for self-driving recorder should be defined to provide an important legal basis for criminal responsibility.
