중국법에서의 선의취득제도

국문 초록

선의취득제도는 선의인 양수인의 신뢰이익을 보호하고 진정한 권리자의 ‘정적’ 소유권을 희생함으로써 거래안전을 보호하는 제도이다. 선의취득제도는 거래안전의 유지 및 거래의 효율을 제고하는 데에도 이바지하므로, 한국과 중국 민법 뿐만 아니라 세계 각국의 민사입법 중에서도 중요한 재산제도이다. 한편, 각국의 경제가 지속적으로 발전하면서 거래도 날로 빈번해지면서 복잡해지고 있다. 그런데 거래관계의 효율을 제고하기 위해서는 선의취득제도의 적용범위도 넓어질 필요가 있으므로 각국에서는 선의취득제도의 입법도 지속적으로 보완하고 있다. 중국에서는 물권법을 공포하기 전에 민법통칙에 선의취득제도에 관한 체계적인 규정이 없었다. 즉, 상대적으로 분산되고 체계화되지 못하였지만 그럼에도 불구하고 사법 실행 과정에서 선의취득제도가 이미 적용되었다. 그 후에 선의취득제도의 운용과정에서 발생한 문제점들에 초점을 두고, 2007년에 공포한 물권법에서 선의취득제도가 체계적으로 규정되었다. 본고는 먼저 선의취득제도의 역사적 근원을 살펴본 다음 한국과 중국에서의 선의취득제도의 성립요건 및 효과를 중점적으로 비교한 후, 이를 통하여 두 나라 법에서의 선의취득제도의 차이점을 발견하고자 하였다.

영문 초록

The system of bona fide acquisition is a system that in order to protect reliance interest of the assignee who has goodwill at the expense of the real rights of ownership interests. The system of bona fide acquisition is conductive to safeguarding the security of transactions system in civil legislation in China and South Korean, as well as in the world. With the development of economy, international trade is become more and more frequently and complexly, and in order to improve the efficiency of the transaction, the application scope of bona fide acquisition is more and more widely. At the same time, the legislation of bona fide acquisition is also improving, Strictly speaking, before the Property Law is promulgated, China’s General Principles of Civil Law did not establish the system of bona fide acquisition. Although there are no complete rules, there were some applications in judicial practice, scattered and loose. According to the chaotic state of the system of bona fide acquisition, China promulgated the Property Law in 2007, which has defined the system of bona fide acquisition. Although the provisions are not perfect, it is of great significance to developing the system of bona fide acquisition of China, and also provide the theoretical basis for Chinese scholars’ research. We will first look at the historical sources of the acquisition system and then compare them around the components of the acquisition system to find the moving points of the acquisition system. In this paper, we first examine the historical roots of bona fide acquisition system, then compare the constituent elements of bona fide acquisition system between China and South Korea, and conclude the similarities and differences between them.
