도로의 하자와 자연력 경합에 대한 손해배상책임

국문 초록

산업의 발달로 많은 도로가 개설, 운영되고 있다. 도로의 종류에 따라 공작물 또는 영조물로 구분되며, 그에 따라 관리주체와 적용법률이 다르다. 즉, 도로가 공작물인 경우에는 관리주체는 사인으로 관리책임에 관한 법률은 민법이고, 영조물인 경우에는 관리주체는 국가 또는 지자체로서 관리책임에 관한 법률은 국가배상법이다. 도로의 하자에 근거한 손해발생의 경우, 법리적으로 일반불법행위를 적용할 수 있지만, 자연력과 경합하는 경우에는 공동불법행위적용문제가 발생한다. 그러나 자연력은 불법행위의 책임주체가 될 수 없어서, 관리주체와 손해전보의 문제를 살펴보아야 한다. 아울러 도로의 하자와 자연력의 경합의 경우를 세 가지로 구분하여 손해배상의 문제를 도로의 하자가 없지만 자연력에만 관계하여 손해발생의 경우, 도로의 하자와 자연력과 함께 손해발생한 경우 및 자연력의 영향 없이 도로의 하자만으로 손해발생한 경우로 나누어 살펴볼 수 있다. 위 세 가지 중에서 주로 문제가 되는 경우는 도로의 하자와 자연력이 함께 손해발생의 원인이 되는 경우로서, 공동불법행위유추적용, 인과관계경합, 과실상계유추적용 등의 견해로 구분하여 논의를 할 필요가 있다. 위 견해를 사례와 구분 없이 일괄적으로 적용할 것이 아니라 사례에 따라서 공평의 원칙하에 손해전보하는 방법을 모색해야 할 것이다.

영문 초록

Today many roads are being opened and operated due to the development of industry. Depending on the types of road, it will be followed by structure and public structure. Accordingly, the management entity and the application act are different. In other words, in the case of road work, the management authority is private person, and the act on management responsibility is civil act. In the case of a public structure, the management authority is the state or local government, and the act on management responsibility is state compensation act. In the case of damage caused by road defects, tort may be applied legal. But in the case with nature force, there is a problem of joint-tort. However, natural forces cannot be responsible for illegal activities, so we should look into the problem of management entity and to cover damage, In addition, there are three cases of road defects and natural force contention. In other words, there are distinguished in the case of damage caused only by natural force, although there are no road defects, in the case of damage along with road defects and natural forces defects in the road and in the case of damage caused by road defects without the influence of natural force. Among the three above, the main problem is the second. In this case, discussions need to be divided into opinions such as the use of analogical application of joint-tort, the use of causal competition and the use of analogical application of compensation negligence. Instead of applying the above views collectively, we should seek to cover damage based on the principle of fairness according to the case studies.
