국문 초록

본 연구는 1991년 설립부터 2009년 제2기 헌법재판소의 임기완료시기까지 불가리아 헌법재판소의 정치적 역할과 영향, 판결의 특성에 대해 살펴봄으로써 체제전환 직후부터 불가리아의 정치발전과정에서 핵심적 역할을 담당해왔던 불가리아 헌법재판소의 정치화 현상에 대한 분석을 시도한다. 이를 위해, II장에서 정치의 사법화(judicialization of politics)와 사법의 정치화(politicization of the judiciary)에 대한 선행연구를 살펴본다. III장은 먼저 1절에서 체제전환 직후 혼란스러웠던 불가리아의 정치발전과정에서 불가리아 정부와 의회의 다양한 정치적 공세에 대한 대응의 일환으로 대통령과의 협력을 통해 사법부의 독립성과 헌법재판소의 권위를 확보하고자 했던 불가리아 헌법재판소의 정치적･전략적 활동에 대해 살펴본 후, 2절에서 판결문 내 반대의견비율에 대한 분석을 통해 불가리아 헌법재판소 판결의 정치화 현상에 대해 살펴본다. 이를 바탕으로 3절에서는 헌법재판청구권한의 독과점적 구조와 체제전환 이후 불가리아의 정치적 양극화를 중심으로 불가리아 헌법재판소 정치화의 원인에 대해 살펴본다. 마지막으로 결론에서는 불가리아 헌법재판소의 정치화 현상이 가지는 이론적 함의와 정책적 시사점에 대해 간략하게 논의한다.

영문 초록

This research aims to examine politicization of the Bulgarian Constitutional Court in the 1990s and 2000s. With its rulings, the Bulgarian Constitutional Court has played a critical role in the country’s political development and transition to a democratic regime through its rulings. As much as Bulgarian government and presidents were eager to bring political hot-potatoes to the constitutional court, the court itself also was not reluctant to make significant decisions on those politically sensitive issues. Therefore, in transitional Bulgaria, judicialization of politics shaped and was shaped by politicization of the judiciary, the constitutional court inter alia. This research first scrutinizes prior studies on both judicialization of politics and politicization of the judiciary. Next, it identifies the Bulgarian Constitutional Court’s strategic and political behaviors that were conducive to consolidate the autonomy and authority of the judiciary, even when it was attacked by the BSP-led parliament and government. The research also examines the politicization of the Court by focusing on dissent ratio in its decisions. Then, the research analyzes potential causes for the politicization of the Court by focusing on individual’s inaccessibility to a constitutional trial and political polarization in post-transition Bulgaria. Lastly, the research briefly discusses some potential theoretical implications and policy recommendations for Korean context.
