국문 초록

우리나라 여성의 정치적 저대표성 문제는 우리 국회와 지방의회의 문제점으로 오랫동안 지적되어 온 것이다. 2000년 이후 여성의 정치적 대표성을 강화하기 위해 여성할당제, 여성정치발전비제도, 여성후보자추천보조금제도 등 다양한 적극적 조치들을 도입하였음에도 불구하고 여전히 정치영역에서의 여성의 과소대표성이 비판을 받고 있는 것은, 제도의 운영의 결과 그 동안 일부 성과를 거둔 부분도 있지만, 여전히 임계치인 30%에는 못 미치는 상황에 머물러 있기 때문이다. 여성의 정치적 대표성이 낮은 이유에 대해서는 지금까지 수많은 사회문화적, 경제학적, 제도적 연구가 있었다. 제도적인 접근은 특히 선거구제와 여성할당제 등 선거제도에 집중하여 여성의 정치적 대표성에 대해 분석하는 것인데, 여성할당제가 여성의 의회진출에는 가장 빠르고 효과적인 방안인 것으로 분석된다. 그러나 할당제는 능력주의나 기회평등의 원칙에 위배되고, 남성에 대한 역차별을 초래하고, 유권자의 선택의 기회도 제한한다. 그래서 여성대표성이 높은 모든 국가에서 법률로 강제하는 할당제가 실시되는 것도 아니다. 따라서 우리 사회의 여성의 정치적 대표성을 강화하기 위한 방안으로 너무 여성할당제에만 집중할 것이 아니라 그 이상으로 중요한 것이 공정한 대표성에 대한 합의와 올바른 제도를 실천하려는 정당의 의지와 여성정치인 스스로의 역량강화라는 사실을 인식하는 것이 중요하다. 물론 우리 사회에서 아직까지는 비례대표제의 도입과 여성할당제의 결합은 여성의 정치적 대표성 확대에 있어 중요한 요건이므로, 공직선거법상 다양한 할당제를 의무규정으로 전환하는 것과 의무할당률 설정 기준 등에 대한 사회적 동의에 대한 협의는 계속 진행해야 할 것이다. 그러나 비례대표의 강제적 여성할당 이외에 지역구의 강제적인 여성할당도 현행 헌법 하에서 가능한지는 여전히 의문이다. 이 문제의 해결을 위한 대안으로 국가의 정책이나 법제정 및 해석 등에 있어서 성평등의 실현에 저해하는 성차별적 장애물을 적극적으로 제거하도록 관련 규정을 개정하고, 정치 및 정책의사결정과정에 대한 여성의 참여를 보장하는 규정을 담아야 한다는 것이 자주 제시된다.

영문 초록

The problem of women s political low representation has been pointed out for a long time as a problem of the Korean National Assembly and the local assembly. Despite the introduction of various active measures such as the women s quota system, women s political development cost system, and women s candidate recommendation subsidy system to strengthen women s political representation since 2000, the underrepresentation of women in the political field is still criticized. As a result of the operation of the system, there have been some achievements in the meantime, but it still remains below the threshold of 30%. There have been numerous socio-cultural, economic, and institutional studies on the reasons why women s political representation is low. The institutional approach is to analyze the political representation of women by focusing on the electoral system, especially the electoral system and the women s quota system. The women s allocation system is considered to be the fastest and most effective way for women to enter parliament. However, the quota system violates the principle of competence or equal opportunity, leads to discrimination against men, and limits voter choice. Therefore, not all countries with high women s representation are mandated by law. Therefore, as a way to strengthen the political representation of women in our society, not only focusing too much on the women s quota system, but what is more important is the political party s willingness to agree on fair representation and the right system and strengthen the capacity of women politicians themselves. It is important to be aware. Of course, in our society, the introduction of the proportional representation system and the women s quota system are important requirements for the expansion of women s political representation. The consultation on Korea will have to continue. However, it is still questionable whether the district s mandatory women s allocation in addition to the proportional representative s mandatory women s allocation is possible under the current constitution. As an alternative to resolving this issue, related regulations were revised to actively remove gender discriminatory obstacles that impede the realization of gender equality in national policies, legislation and interpretation, and women s participation in the political and policy decision-making process. It is often suggested that provisions should be made.
