긴급사태에서 식품의 안정적인 공급을 위한 연구

국문 초록

2017년 3월에 제정된 식품확보준비법은 군사적인 긴급사태에서 식량의 안정적인 공급을 목적으로 1965년에 제정된 식품확보법과 비군사적인 긴급사태에서 식량의 안정적인 공급을 목적으로 1990년에 제정된 식품준비법을 일원화한 것이다. 다만 이들은 기존 법률을 단순히 일원화하였을 뿐 아니라, 전쟁의 위기가 항시 예상되지 않는 현대사회에서 위기발생의 개연성에 비례한 위기대책을 강구하는 것을 목표로 하였다. 2019년 12월에 발생한 COVID-19(신형 코로나바이러스감염증세)에 의하여 주요국의 긴급사태선언 및 행동규제조치(외출규제와 영업규제 등)가 지속적으로 발표됨에 따라 비군사적인 재해에 의한 안정적인 식량의 확보가 무엇보다 중요하게 되었다. 특히 물류 및 인적 자원의 이동이 제한됨에 따라 국제적으로 식량공급체계에 차질이 생길 수 있기 때문에 장기적으로 식량의 수요와 공급에 상당한 변화가 야기될 수 있다. 그러므로 국경봉쇄조치로서 식량의 수입의존도가 높은 국가에서는 식량안보문제를 비롯하여 수입원자재의 가격의 상승으로 식품가격이 상승될 우려가 있다. 그동안 우리나라에서는 군사적 긴급사태 이외에 비군사적 긴급사태의 대응체계를 구축하기 위한 제도적 논의가 충분하지 않았고, 긴급명령 및 긴급재정경제명령권과 계엄선포권이 규율되었음에도 불구하고, 그 적용요건이 엄격하였기 때문에 이 글에서는 2017년에 제정된 독일 식품확보준비법을 비교법적으로 살펴봄으로써 향후 우리 법에서 각종 재해 및 재난 등에 따른 안정적인 식량공급체계를 구축하기 위한 체계적인 법적 근거를 마련하고자 하였다.

영문 초록

The Food Security Preparation Act, enacted in March 2017, combined the Food Security Act in 1965 for the stable supply of food in a military emergency, and the Food Preparation Act in 1990 for the stable supply of food in a non-military emergency. However, this aimed not only to unify the existing laws, but also to take countermeasures that are proportional to the probability of the occurrence of a crisis in present-day society where the crisis of war is not always expected. With the recent emergence of COVID-19 (a new type of coronavirus infection), the emergence of emergency declarations and regulatory actions in major countries (such as out-of-bounds regulations and business regulations) has led to the importance of securing stable food from non-military disasters. In particular, as the movement of logistics and human resources is restricted, there may be a disruption in the international food supply system, because it would bring about a significant change in food supply and demand over the long term. Therefore, in countries where food import dependence is high as a blockade measure, there is a concern that food prices may rise due to food security issues and rising raw material prices. Thus, since there were not enough institutional discussions to build a response system for non-military emergencies other than military emergencies in Korea, and despite the strict regulations on emergency orders, emergency financial and economic orders and martial law proclamation rights, in this article it seeks to lay a systematic legal basis for establishing a stable food supply system following various disasters and calamities in the future by reviewing the German Food Securing Preparation Act enacted in 2017.
