국문 초록

이 연구는 <5･18민주화운동 진상규명을 위한 특별법>에 의해 출범한 <5･18민주화운동 진상규명 조사위원회>가 5･18 항쟁기를 전후하여 발생한 국가폭력의 여성인권유린, 특히 성폭력에 대한 진상규명을 효과적으로 할 수 있도록, 당시에 여성들이 겪었던 전반적인 피해와 성폭력 피해를 여성주의 관점에서 분석함으로써 동법의 미비점에 대한 정책적 제안을 도출하는데 목적이 있다. 5･18항쟁 초기에 계엄군들은 저항하는 시민들을 제압하기 위해 여성들에게 과시적이고 잔혹한 폭력을 행사하였으며, 여성피해자들은 사망, 부상, 연행과 구금, 수사 과정에서 성폭력을 포함하여 여러 가지 방식으로 인권을 유린당했다. 본론의 고찰은 지금까지 제대로 규명되지 못한 성폭력의 진상을 밝히기 위해서는 ‘5･18 진상규명 특별법’이 성폭력을 조사할 수 있도록 개정되어야 할 필요성을 제기한다. 동 특별법이 국가권력에 의해 자행된 성폭력의 진실을 밝히고 젠더 정의(gender justice)를 실현할 수 있으려면 아래와 같은 세가지 점이 개정, 보완되어야 한다. 첫째, 특별법의 조사대상이 되는 범죄행위의 규정에 ‘성폭력범죄’를 추가하여 5･18항쟁기의 성폭력을 본격적인 조사대상으로 설정해야 한다. 둘째, 조사과정에서 또 다른 2차 피해(secondary victimization)가 발생하지 않도록 ‘5･18진상 조사위원회’ 내에 전문성을 갖는 전문위원회를 설치하여 운영해야 한다. 셋째, ‘피해자’의 범위를 포괄적으로 규정하기 위해 ‘피해자’의 범위를 5･18민주화운동‘당시’ 로 규정하는 현행법의 조항을 ‘5･18민주화운동’ ‘전후’로 개정하여 조사범위와 피해구제 범위를 확장해야 한다. 5･18항쟁 이후 수사과정과 구금기간 동안에 발생한 성폭력을 조사하기 위해서는 조사기간의 범위를 확장하는 것이 중요하다. 국가권력에 의한 성폭력에 대한 진상규명이 제대로 이루어지고 재발을 방지하려면 ‘조사’에 초점을 두는 동 특별법의 개정만으로는 불충분하다. <5･18민주화운동 진상규명 조사위원회>는 성폭력 피해여성들이 침묵을 깨고 2차 피해에 대한 두려움 없이 자신들의 억압된 경험들을 말할 수 있는 사회적 분위기를 조성해야 한다. 뿐만 아니라, 준전시상황에서 발생한 국가권력에 의한 성폭력을 ‘인도에 반하는 범죄’(crimes against humanity)로 볼 수 있다면, 좀 더 포괄적인 인권법체계 속에서 그에 대한 법적 처벌이 어떻게 가능할 것인지 모색해야 한다.

영문 초록

This research is aimed to render some suggestions to the National Commission of Truth Revelation of 5･18 Democratization Movement in order that it is able to investigate sexual violence occurred during/around 5･18 Uprising period. Female victims are various in 5･18 Uprising such as the dead, the injured, the arrested and the detained. The perpetrators of state violence committed the conspicuous sexual offences to horrify the resistant citizens whom they defined and treated ‘enemy’in the quasi-war time. However, female victims could not tell their story for a long time because of the trauma and the secondary victimization. This research has reviewed the experiences of the female victims in the feminist perspective, and raise the suggestions as follows. Firstly, objects of investigation under the Special Law on the Truth Revelation of 5･18 Democratization Movement, need to be expanded so as to include sexual violence to be stipulated in the current Special Law on the Sexual Violence. Secondly, the specialized committee for sexual violence has to be made in the National Commission of Truth Revelation of 5･18 Democratization Movement, to prevent the secondary victimization from happening while investigation. Thirdly, provision on the period of investigation should be amended to include the period ahead /after the 5･18 Uprising since the current law is able to investigate the human rights violations occurred only in the period during the 5･18 Uprising. Except for the amendment of the Special Law, two more tasks are remained to reveal the truth of sexual offences by the state violence. The National Commission of Truth Revelation of 5･18 Democratization Movement also need to make an effort to boost the social atmosphere to make victims feel comfortable to speak out their traumatic experience. Ultimately, the two legal questions that the sexual violence committed under the martial law, is able to be regarded as ‘crimes against humanity’and to punish the perpetrators in order to fulfill the gender justice, should be answered.
