주체성과 형사책임에 대한 연구

국문 초록

책임의 근거와 관련하여, 도의적 책임론과 사회적 책임론의 근본적인 대립이 있어 왔다. 도의적 책임론은 자유의지를 인정하기에(비결정론) 개개 행위에 있어서 적법행위의 가능성이 있음에도 불구하고 위법한 행위를 선택한 행위자의 ‘의사’에 비난의 초점을 맞춘다. 이에 반해 사회적 책임론은 인간에게 자유의지가 있다는 것은 주관적 환상이며, 인간의 행위는 소질이나 환경과 같은 요인에 의해 결정되어진다고 생각한다(결정론). 때문에 사회적 책임론은 개개의 행위가 아니라 행위자의 ‘성격’ - 사회적 위험성- 에서 책임의 근거를 찾는다. 그리고 도의적 책임론과 사회적 책임론의 극단적 입장의 한계를 극복하고자 인간의 자유의지를 긍정하면서도 동시에 소질과 환경의 영향 또한 인정하는 인격책임론이 등장하였다. 인격책임론의 요체를 한마디로 말하면, 인간의 행위는 행위자의 인격을 떠나서는 정당하게 이해될 수 없다는 것이다. 이 인격적 책임론과 관련하여서 한국과 일본에 대표적인 학자가 있다. 박정근 교수와 단등중광 교수이다. 단등중광 박사는 동경대 교수와 일본 최고재판소 판사를 역임한 분으로 인격형성책임과 관련해서는 세계적 학자이다. 한편, 박정근 교수는 단등 교수의 인격책임론에 강한 영향을 받았다. 그로 인해 일본으로 건너가 단등 교수의 시사로 인격책임에 관한 연구를 심화시켰다. 박정근 교수나 단등 교수의 학문적 골간은 인간의 주체성을 인정하는 주체성 이론이며 이를 근거하여 나온 것이 인격책임론이다. 하지만 주체적 인간에 대한 인간상에서 두 분의 견해는 차이가 있다. 단등 교수는 심신일원론적(心身一元論的) 인간상에서 주체적 인간을 인정함에 반해 박정근 교수는 심신일원적 인간상에서는 초인과적 주체를 끌어낼 수 없다는 입장이다. 박교수는 프랑클의 실존분석적·차원존재론적 인간상을 받아들여, 인간을 신체(Leib)·심(Seele)·정신(Geist)의 통일체로 이해하고, 정신적 차원에서만 참된 인간을 파악할 수 있다고 보았다. 그리고 이 정신은 심·신 그리고 환경에 의해서 제약은 받을 수 있지만 이것들에 의해 완전히 결정되어 질 수는 없다고 보았다. 이상의 견해 차이에도 불구하고 두 분 모두 인간 존엄의 본질은 인간이 주체성을 가지고 있기 때문이라 점에 대해서는 일치한다. 박정근 교수와 단등중광 교수는 인간존엄을 확인하고자 인간의 주체성을 형사책임과 연결시키고자 노력하신 분들이다. 필자는 이러한 사정으로 단등 박사의 주체성이론과 인격책임론의 사상적 배경과 이론을 고찰하고 박정근 교수의 주체성론과 인격책임의 신이론의 발전과정을 따라가 살펴보았다.

영문 초록

Criminal liability is culpability: if the doer is not culpable, the crime cannot be established. There has been a fundamental opposition between moral liability(moralische Schuld; indeterminism) and social liability(soziale Verantwortlilchkeit; determinism) regarding the basis for liability. The two sides are most distinctly divided over whether to acknowledge the idea of free will or not. As moral liability recognizes the existence of free will, it sets its focus of criticism on the doer’s “will” to engage in an illegal act despite the possibility of engaging in a legal act. Contrarily, social liability claims that the idea of free will is a subjective illusion, and that humans’ actions are determined by factors such as one’s predisposition and environment. Thus, it finds the basis for liability in the doer’s nature - a societal risk - and not the individual’s act. And, in order to overcome the shortcomings of the two extremes, personal liability, which recognizes both the idea of free will and the influence of predisposition and environment. In short, personal liability claims that human conduct cannot be rightfully understood apart from the doer’s character. There are two distinguished scholars in the field—professor Jung-kun Park and professor Dando Sigemich. Doctor Dando is an eminent scholar in the field of personal liability, who had previously served as a professor at Tokyo University and as a justice of the Japanese Supreme Court. Professor Jung-kun Park has been strongly influenced by professor Dando’s personal liability; after going over to Japan, he published 『The New Theory of Personal Liability』 with the help of professor Dando, and obtained his doctorate with the thesis. Both professors’ theories revolve around the acknowledgment of free will, but they have different views towards the image of autonomous human being. The essence of human dignity is our autonomy. In an attempt to ascertain human dignity, professor Park and Professor Dando strived to connect human autonomy with criminal liability. This writer will examine professor Dando’s autonomy theory and personal liability, and will also follow the process of development of professor Park’s new theory on personal liability.
