리얼돌과 형사규제의 필요성

국문 초록

대법원이 리얼돌에 대한 수입을 허가하는 판결을 내린 이후, 리얼돌을 둘러싼 국민 청원과 거센 찬반논쟁에도 불구하고 국내 법체계에서는 여전히 리얼돌에 관한 명확한 규정이 없다. 오히려 리얼돌에 대한 관심이 급증하여 돈을 받고 리얼돌을 대여해주는 리얼돌 체험방이 우후죽순 늘어났다. 기존의 성매매업소와 유사한 이 리얼돌 체험방은 주거지역과 교육 시설이 밀집한 지역에까지 들어서서 주민들의 우려와 반발이 발생하고 있지만, 리얼돌은 사람이 아니기 때문에 ｢성매매특별법｣을 적용시킬 수 없고, 대법원이 리얼돌을 음란물로 보지 않고 단순한 성인용품으로 판단하여 수입을 허용함에 따라 ｢풍속영업규제법｣으로도 처벌하기 어려운 실정이다. 그나마 아동 리얼돌에 대해서는 아동의 성적 대상화와 성착취를 막기 위하여 ｢아동·청소년의 성보호에 관한 법률 개정안｣이 발의되었지만, 임기 만료로 폐기되었다. 많은 국가에서 이미 아동형상의 리얼돌을 법으로 금지하고 있는 만큼, 우리나라도 ‘아동신체형상성기구’에 해당하는 ‘아동’에 대한 기준을 조금 더 구체적으로 추가하여 하루 속히 개정안을 갖추어 시행할 필요가 있다. 한편 아동 리얼돌과는 달리 성인 리얼돌의 경우, 단순한 성인용품 중 하나라는 인식에 따라 사적인 영역으로 보아 규제하는 것을 자제하려는 경향이 강하다. 그러나 리얼돌은 일반 성기구와 다르다. 사람의 형상과 거의 흡사한 ‘실물’이기에, 여성의 신체나 성 관념 등에 왜곡된 인식을 가지게 할 수 있기 때문이다. 더욱이 특정인의 모습으로 맞춤 제작이 가능한 만큼 리얼돌과 관련된 사회적 문제와 위험성은 점점 더 늘어날 가능성이 크다. 아동에 대한 성적 대상화와 성착취를 막기 위하여 아동 리얼돌을 금지하는 것처럼, 성인 리얼돌도 그 사회적 유해성을 비추어 보아 금지되어야 마땅하다. 따라서 이를 명확히 단속할 수 있는 체계적인 법 개정이나 입법이 필요하지만, 현재 대안으로는 리얼돌을 형법 제234조 및 제244조의 음란한 물건으로 보아 규제할 수 있을 것이다.

영문 초록

After the Supreme Court decided to approve the import of real dolls, there were the national petition and fierce controversy surrounding real doll. But in the domestic legal system, there is still no definite regulation on real dolls. Rather, interest in real dolls has skyrocketed, and the number of real doll experience rooms that rent real dolls for money has increased. This real doll experience room is similar to brothel, but it is impossible to apply the “Act on the Punishment of Arrangement of Commercial Sex Acts”, because real doll is not a person, and it is difficult to punish even by the “Act on the Regulation of Amusement Business Affecting Public Morals”. Though regarding child-like real dolls, the “Act on the Protection of Children and Youth against Sex Offenses” has been proposed to prevent sexual targeting and sexual exploitation of children, but it was discarded due to expiration. As many countries already prohibit child-like real dolls by law, it is also necessary for Korea to prepare and implement amendments as soon as possible. On the other hand, unlike children s real dolls, adult real dolls tend to refrain from regulating them as a private area based on the recognition that they are just one of adult products. However, real dolls are different from ordinary sex toys. Because it is a “real thing” that closely resembles a person s shape, so it can have a distorted perception of a woman s body or sex. Moreover, the social problems and risks associated with real dolls are likely to increase more and more as they can be custom-made in the form of a specific person. Just as children s real dolls are prohibited to prevent sexual objectification and sexual exploitation of children, adult real dolls also should be banned because of their social hazards. Therefore, a systematic amendment or legislation is needed to clearly control this. But as an alternative, real dolls could be regulated by viewing them as obscene objects in Articles 234 and 244 of the Criminal Act.
