국문 초록

본 논문에서는 EU가 지리적 표시제(GI)의 범세계적 확산을 위해 다자간 및 양자간 협상전략을 진행하고 있음을 분석하였다. 첫째, EU는 최근 세계지적재산권기구 리스본협약 내 제네바법 개정을 이끌며 다자적 차원에서 GI 국제규범을 확산시키고 있다. 둘째, EU는 FTA 협상 내 GI 조항을 강화하거나, 독자적 GI 양자협정을 통해 GI 규범을 확산해 왔다. EU는 최근까지 26개 GI협정을 체결해 왔다. 본고에서는 EU가 최근 추진한 GI 세 개의 GI관련 협상을 고찰하였다. 이는 EU-멕시코 개정 FTA, EU-일본 EPA 및 EU-중국 양자협정에서의 GI 협상과정 및 결과에 해당한다. 결과적으로 GI는 국제규범화하여 좀 더 많은 영역에서 교역주체의 양 당사국 시장에서 제3국 제품에 대한 GI 침해 시 이에 대한 제재가 가능해 지고 있다. 더불어 GI 대상 품목 또한 농식품, 주류는 물론이고 비농산품 나아가 건축 등에까지 확산될 전망이다. GI는 특히 사회·문화·역사적으로 근접한 지역 내 국가들의 충돌 문제를 야기할 수 있다. 이에 한국 정부는 선제적으로 GI 국제규범 강화 및 범위 확대를 관리할 필요가 있다.

영문 초록

This paper analyzed that the EU has been carrying out multilateral and bilateral negotiation strategies to promote the global spread of geographic indicators (GI). First, the EU has recently led the revision of the Geneva Law in the Lisbon Convention of the World Intellectual Property Organization and is spreading GI international norms at a multilateral level. Second, the EU has strengthened GI in FTA negotiations, or has spread GI through independent GI bilateral agreements. The EU has signed 26 GI agreements until recently. This paper reviews the three GI-related negotiations recently promoted by the EU. The three cases of negotiations are the EU-Mexico revised FTA, the EU-Japan EPA, and tthe EU-China GI bilateral agreement. As a result, GI has become an international standard, and it is possible to impose sanctions on GI infringement on third-party products in the market of both parties in the trading partners in more fields. In addition, the scope of GI has been expanded. The object items are expected to spread not only to agricultural products and alcoholic beverages, but also to non-agricultural products and architecture. GI is particularly prone to conflict issues between countries in regions that are socially, culturally and historically close. Therefore, the Korean government needs to proactively manage to strengthen GI international norms and expand its scope.
