포르투갈 이민법의 최근 동향과 향후 과제

국문 초록

포르투갈은 지정학적·역사적 특성에 기인하여 이민자의 유입과 유출이 활발하게 나타난다. 포르투갈 정부는 역사적 변동 속에서 이민정책과 관련 제도를 변화시키며, 외국인의 투자를 유치하고 사회 발전을 도모해 왔다. 포르투갈의 이민제도는 EU의 정책과 법에 부합해야 한다는 과제도 있었으므로, EU의 시민권 개념과 자유로운 이동의 보장에 관한 EU 차원의 기준에 따라서 변화하기도 하였다. 포르투갈 이민제도의 변화에 따라 이민법도 변화해 왔으며, 1981년에 제정된 포르투갈 이민법은 유럽통합의 과정과 함께 변화를 거듭함과 동시에 포르투갈 사회의 요청과 정부의 정책에 따라 개정되기도 하였다. EU의 전반적인 이민 기준의 변화와 포르투갈 내부의 경제 및 사회의 변동 역시 이민법의 변화에 영향을 미쳤다고 볼 수 있다. 특히 포르투갈에는 많은 수의 영국인들이 투자를 통해 거주하고 있기 때문에, 최근의 브렉시트 상황은 포르투갈 이민법에도 영향을 줄 가능성이 다분하다. 이에 따라 탈퇴협정에 의한 이행기간이 지난 후에는 포르투갈 이민법의 변화가 불가피할 것으로 전망된다.

영문 초록

Portugal has an active inflow and outflow of immigrants due to its geopolitical·historical characteristics. The Portuguese government has changed immigration policies and related systems amid historical fluctuations, attracted foreign investment and promoted social development. The immigration system of the country also had a challenge to comply with EU policies and laws, so it has changed according to the concept of the EU citizenship and the EU standards for ensuring free movement. The Portuguese Immigration law has changed as the Portuguese immigration system has changed. The Portuguese immigration law, which was enacted in 1981, has changed over the course of the European integration and at the same time has been amended in response to requests from the Portuguese society and the governmental policies. Then, the immigration law will also change due to the changes of the EU overall immigration standards and the changes of the Portuguese economy and society. The recent Brexit situation will have a major impact on the Portuguese immigration law because of a large number of British residents living with the investments. The changes in the Portuguese immigration law will be inevitable after the transition period under the withdrawal agreement.
