코로나19 사태로 비추어 본 반려동물 원격진료 도입 가능성에 대한 법적 고찰

국문 초록

코로나19 바이러스는 사람뿐만 아니라 반려동물에도 감염될 수 있다는 가능성이 제기되었고 실제로 미국, 홍콩 등 여러 나라에서 확진자의 반려견에 양성 반응이 나타난 사례가 있었다. 그렇지 않아도 코로나19 사태로 반려동물을 동반하여 외출하는 것이 어려웠던 상황과 겹쳐 반려견에게도 코로나19가 감염될 수 있다는 사실이 확인되어 반려동물 양육자들의 우려가 커지고 있다. 이에 따라 양육자들은 반려동물의 건강에 문제가 생겼을 때 직접 동물병원에 데리고 가기보다는 스마트폰 어플리케이션을 통한 진료상담을 하는 등 차선책을 찾는 방식으로 그들의 반려동물을 케어하고 있다. 그러나 스마트폰 어플리케이션을 이용하는 방식으로는 개별적인 진단에 기반한 진료를 받을 수는 없고 일반적인 진료상담 서비스밖에 받지 못한다는 점에 한계가 있어 안심할 수는 없는 실정이다. 국내법상 동물의 원격진료 행위는 허용되지 않아 IT 서비스를 활용한 진료는 보편적인 경우에 적용할 수 있는 상담의 형식으로 이루어지고 있기 때문이다. 그러나 반려동물의 건강권을 실현하고 원격진료를 시도하려는 국제적 흐름에 뒤처지지 않기 위해서는 동물 원격진료의 도입 가능성을 검토해 볼 필요가 있다. 선행적으로 수의사가 직접 방문을 하거나 동물병원 방문을 통하여 직접적인 진단이 있었던 경우에 한하여 진단을 내렸던 수의사와의 원격진료를 제한적으로 시도하는 방안, 그리고 해당 동물 및 의뢰인이 격오지에 있어 상시적으로 동물병원에 방문하는 것이 어려운 지역에 한하여 제한적인 범위에서 시도하는 방안이 고려된다. 이를 위해서는 동물 치료에 사용하는 의약품을 수의사가 처방할 수 있는 의료체계로 입법적 개선이 선행되어야 하며, 일부 대형 동물병원으로 진료 의뢰가 쏠리는 현상을 대비하여 시행 초기부터 방지대책을 마련하는 방향으로 사전적인 준비가 필요할 것이다.

영문 초록

The spread of COVID-19 virus has raised the possibility that companion animals can also get infected. Indeed, a small number of companion animals have been confirmed to be infected with the virus that causes COVID-19 worldwide and companion animals’ owners have concerned for the safety of their companion animals. As it is difficult to go out with companion animals, various IT services considering the animal rights to health emerged, and people using platforms such as medical consultation through smart phone applications are also increasing. However, there is a limit in that it is only a consultation service for pets and is not an individual diagnosis. This is because the domestic law does not allow animals to receive medical treatment remotely. However, it is necessary to consider the possibility of introducing veterinary telemedicine in order to protect the implementation of animals rights to health and keep pace with global trends. Only in the case of a veterinarian s direct visit or a direct diagnosis through a visit to an veterinary clinic before, limited remote treatment with the veterinarian who made the diagnosis may make an attempt. In addition, it is also possible to conduct veterinary medicine within a limited range only in areas where the animals and clients are in remote areas and have difficulty visiting at all times. Furthermore, legislative improvement is needed as a medical system that veterinarians can prescribe medicines used for animal treatment, and it is necessary to prepare a preventive measure from the beginning of the implementation for a scenario that a request for medical treatment is concentrated in some large veterinary clinics.
