생명윤리에서 인간의 존엄 근거 고찰

국문 초록

이 글은 생명윤리 논쟁에서 인간의 존엄 의미가 분열되는 듯한 현상에 문제의식을 가지고, 생명윤리에서 인간의 존엄 근거를 고찰하고자 다음을 살펴보았다. 첫째, 인간의 존엄을 이해하는 방식을 도출하였다. 둘째, 인간의 존엄의 근원은 그리스도교이고, 이후 칸트가 인간의 존엄을 제안하였고, 양자의 영향으로 법적 가치로서 인간의 존엄이 파생하였다. 셋째, 생명윤리 논쟁에서 거론되는 자율성의 두 가지 근원을 살펴보았다. 하나는 인간의 존엄론과 명시적으로 관련된 자율성이고, 다른 하나는 생명의료윤리원칙의 하나인 ‘자율성 존중’원칙과 관련된 ‘사전동의’에서의 자기규율성이다. 그리고 양자는 맥락과 의미를 혼동한 채 사용될 가능성에 열려 있다. 넷째, 법적 가치로서 인간의 존엄과 생명윤리에서 인간의 존엄은 인간의 보호를 목적으로 하고, 생명윤리에서 인간의 존엄은 인간의 실존형식인 개인의 생명보호이다. 결론적으로, 생명윤리에서 인간의 존엄 근거는 개인의 생명보호에 있고, 인간의 존엄은 개인의 생명을 보호하는 실천을 통하여 구현됨을 제시하고자 한다. 그리고 생명윤리 논쟁에서 인간의 존엄은 인간의 실존형식인 개인의 생명보호를 의미하므로, 문제해결의 논점은 개인의 생명보호 방안 모색에 집중해야 할 것을 제안한다. 이 지점에서 토마스 아퀴나스 인격론은 우리에게 시사점을 주는데, 인간의 지성은 인간의 본질적 가치인 개인 생명의 실체성·개별성·자립성을 인식할 수 있고, 칸트에서 인간이 존엄함을 드러내는 윤리성은 생명윤리 논쟁에서 개인 생명의 실체성·개별성·자립성을 보호하는 것에서 발휘되어야 함을 전망할 수 있다.

영문 초록

This article examined the following to examine the grounds for human dignity in bioethics with a problem consciousness of the phenomenon that human dignity seems to be divided in the bioethics debate. First, it draws a way to understand human dignity. Second, the source of human dignity is Christianity, and then Kant proposed human dignity, and human dignity as a legal value was derived from the influence of both. Third, two sources of autonomy discussed in the bioethics debate were examined. One is autonomy, which is explicitly related to human dignity, and the other is self-regulation in the ‘conformed consent’ related to the principle of ‘respect for autonomy’, one of the principles of biomedical ethics. And both are likely to be used confused with context and meaning, in which case the human dignity can be compromised. Fourth, human dignity in bioethics and human dignity as a legal value aims to protect human beings, so human dignity in bioethics can be embodied as an individual s life protection practice. In conclusion, I would like to suggest that the basis of human dignity in bioethics lies in the individual s life, and that human dignity is realized through the practice of protecting the individual s life. And in the bioethics debate, the practice of human dignity is an act of protecting his life, which is the essential value of man and the existential form of the individual, so the issue of problem solving focuses on finding ways to protect the life of the individual. At this point, Thomas Aquinas persona theory gives us implications: human intelligence can recognize the life of an individual as an essential value of person as substantiality, individuality, and self-subsistencee, and It can be predicted that the ethics that reveal human dignity in Kant should be exercised in the bioethics debate in protecting the substantiality, individuality and self-subsistence of individual lives.
