인권 가치에 기반한 분배 기준

국문 초록

본 논문은 분배 문제에 인권기준을 적용하기 위한 기초적 연구다. 기존의효율성 기준, 공정성 기준 대신에 인권 가치를 기준으로 분배 상태를 평가하는 방법을 논의한다. 이를 위해 인권이론의 특성을 살펴보고 ‘최소주의’, ‘점진적 실현’, ‘의무담지자’의 3가지 개념을 분배 문제를 평가하는데 활용한다. 인권이론의 특성을 반영한 분배규칙을 도출했으며, 생존을 우선하는 개인의선호관계와 인권보장을 우선하는 의무담지자의 선호관계를 설정한 후 2인-2 재 모형을 구성했다. 그리고 도출한 규칙과 모형을 이용해 인권 기준을 기존의 논의들과 비교했다. 본 연구는 인간으로서 필요한 최소 수준의 분배와 이를 보장할 수 있는 의무담지자의 역량에 대한 논의에 집중하고, 사회가 수용할 수 없는 분배는 어떤 상태인지를 고찰하는데 관심을 기울였다.

영문 초록

This paper reports basic research that aims to apply human rights standards to the issue of distribution. This study discusses using human rights, rather than efficiency or fairness, as standard to evaluate the status of distribution. To do so, the characteristics of human rights theory were examined and three concepts were used to assess the distribution issue, namely, “minimalism,” “progressive realization,” and “duty-bearer.” This study derives allocation rule based on human rights characteristics. In addition, the present study established the preference relation of consumers, who make survival a priority; set up the preference relationship of duty-bearers, who prioritize the guarantee of human rights; and then built two-person, two-good model. Using the allocation rule and model, this study campare human rights standard with previous discussions. The present study focused on discussing what the minimum level of distribution required for human beings would be, the capacity of duty-bearer, who can guarantee such a level, and what state of distribution could not be accepted by society.
