국문 초록

우리나라에서 전관예우라는 현상을 만들어내는 관료와 기업의 유착은 명시적이고 불법적인 담합이라기 보다는 합법과 불법의 경계에서 회전문 취업을 통해 이루어지는 암묵적 담합이라고 볼 수 있다. 본고는 이러한 특성을 반영하여 감독기관 관료와 기업의 유착을 관료의 감독노력과 더불어 모형화하고, 전관예우가 언제 어떻게 균형에서 나타나는지 이론적으로 고찰한다. 모형에는 전관예우는 없으나 감독노력이 낮은 균형, 전관예우가 있으면서 감독노력이 낮은 균형, 그리고 전관예우가 있지만 감독노력이 높은 균형이 존재한다. 본고는 이 균형들의 비교를 통해 전관예우가 사회적으로 바람직할 수 있는지, 만약 바람직할 수 있다면 언제 그리고 왜 바람직한지 밝혀 전관예우와 관련한 정책적 함의를 제공한다.

영문 초록

In Korea, the coalition between bureaucrats and firms that create the phenomenon of courtesy to formal officials is not an explicit and illegal collusion, but rather an implicit collusion through the employment of a revolving door at the legal-illegal border. This paper reflects these characteristics and models the coalition between supervisory bureaucrats and firms, along with the bureaucratic oversight effort, and theoretically studies how and when the courtesy to formal officials appears in equilibrium. In the model, there exist three types of equilibria: an equilibrium with no courtesy to formal officials and low oversight effort, an equilibrium with the courtesy and low oversight effort, and an equilibrium with the courtesy and high oversight effort. This paper compares these equilibria to see whether the courtesy to formal official can be socially desirable, and when and why it is desirable, to provide policy implications.
