同性婚姻과 異姓婚姻 - 혐오와 수치심 -

국문 초록

인간은 혐오스러운 상황에서 보편적인 결정으로 낙인(烙印)함으로써 그 대상에게 수치심을 부여한다. 인간 스스로 혐오의 범주를 그어놓고 혐오스러워한다. 그렇다면 혐오의 범주는 타당성 있는 구획(區劃)인가? 아니면 인간 스스로 정해놓은 구획의 틀에 갇혀 혹 그것이 혐오스럽지는 않은가? 역사적 관점에서 문화라는 것은 한 순간에 단절되고 단칼에 정리되지않는다. 왜냐하면 부정적인 문화도 뿌리 깊게 자리 잡은 속성까지 깨끗이 없애는 일이 불가능하기 때문이다. 본고에서는 동양사회의 관점으로 혐오와 수치심에 대하여 역사적인 면을 고찰하였다. 이에 인간이 만들어낸 형벌에 대하여 상나라 때 갑골문에 드러난 형벌에 대해 살펴보았고, 동성애에 대한 문헌적 사실(史實)을 통해 살펴보았으며, 근대에 인간이 자행한 우생학적 측면으로써의 단종법을 고찰하여 혐오와 수치가 인간에게 주는 영향에 대해 논의하였다. 이러한 역사관점의 근거를 통해 동성혼의 비판과 함께 이성혼인에 대해 논의하고 유가관점에서 혼인이 왜 중요한 것인가를 다루었다.

영문 초록

By stigmatizing with universal decision in a disgusting condition, we make others feel ashamed. In addition, we feel hateful under the category of hatred made by us. Then is the category of hatred the valid section? Or is it not disgusting when we are confined in the framework made by ourselves? In the historic viewpoint, a kind of culture cannot be severed or annihilated at a time. It is impossible to uproot it, since even the negative culture has its own root. Hatred also cannot be exterminated like the deep-rooted culture. This study investigated the historic side of hatred and shame from the Oriental viewpoint. For this, as for punitive measures made by human beings, the punitive system on the shell-and-bone characters in Sang dynasty was examined. The bibliographical facts about homosexual love were reviewed. And the effects of hatred and shame on human beings were discussed, following the consideration of eugenical sterilization committed by human beings in modern times. Based on the foundation from these historic viewpoints, the heteronymous marriage will be discussed, along with criticism of homosexual marriage. In addition, the importance of marriage will be mentioned from the Confucian viewpoints.
