국문 초록

본 논문에서는 먼저 (i) SAE 자동화기술의 단계구분이 어떠한 것인가를 살펴본 다음, 이러한 단계구분에서 사용되는 핵심적 개념인 “역동적 운전작업” 등에 기초해 (ii) 인간의 ”운전작업”을 분류해 보았다. 다음으로 (iii) SAE 자동화 단계구분이 어떠한 법적 의미를 가지는가를 탐구해 보았는데, 먼저 공학적 기준인 SAE 자동화기술 단계구분 및 이에 따른 ‘운전작업의 분류’가 자율주행차 운전자의 사고책임을 다루는데 있어 어떻게 적용되는지를 살펴보았다(운전자의 과실책임에 대한 영향). 다음으로 SAE 자동화기술의 단계구분이 자동차안전기준규제에 어떠한 영향을 미치는지를 살펴보았고(규제법에 대한 영향), 마지막으로 SAE 자동화기술 단계구분이 결함책임인 제조물책임에 어떠한 영향을 미치는지를 제조물책임법의 관점에서 다루어 보았다(제조물의 결함책임에 대한 영향). 앞서 살펴본 비역동적 운전작업과 같이 ADS의 기술수준이 높아짐에도 불구하고 여전히 인간의 결정을 필요로 하는 운전작업은 잔존할 것으로 생각되고 이러한 운전작업의 수행으로 인한 책임은 여전히 인간 사용자에게 잔존할 것이므로 앞으로 이러한 영역에 대한 운전작업의 유형을 발견하고 그 책임의 내용을 구체화하는 작업이 필요할 것이다.

영문 초록

In the first part of this article, I examined SAE Levels of Driving Automation and the basic definitions used in J3016. After examining the Levels and the basic concepts, I went on to classifying human driving tasks into four categories on the bases of the definitions ie. (i) dynamic driving task(DDT), (ii) DDT fallback, (iii) securing minimum risk condition and (iv) Non-DDT. From these observations, I drew some legal implications that I dealt with in the second part of this article. Among other things, I investigated the legal impact of the SAE Levels of Driving Automation upon the drivers’ liability regime for autonomous vehicles (AVs) accident, and argued that as the SAE Level of a particular AV goes up, the likelihood of the driver’s liability goes down due to the existence of the ADS exercising the driving task in the driver’s shoes. I also dealt with the impact of the SAE Levels upon the safety standard regulation for AVs and their ADSs, and argued that there should be separate safety standard regulations for each SAE Levels of AVs or ADSs because they are different car categories. Finally, I examined the impact of the SAE Levels upon the product liability regime for defects in a AV or an ADS, and argued that the current SAE Levels stand for the prevailing standards for the science and technology for AVs and ADSs, and thus the standard should be used as a defence by the AV or ADS maker as a highest level of automated driving technology.
