납북자 문제의 현황과 해결방향

국문 초록

납북자 문제는 2005년 이래 유엔 총회가 다루는 글로벌 이슈가 되고 있다. 이 문제는 국가테러리즘, 불법 억류, 강제실종, 인권 침해 지속, 자국민 보호 등 복합적인 요소를 갖고 있다. 이 때문에 남북관계에서 한국이 직면한 난제 중의 하나라 할 수 있다. 그동안 한국 정부와 대한적십자사는 인도적 차원에서 이 문제를 접근해 왔다. 하지만 지난 20년 동안 이룩한 성과는 그리 만족스러운 수준이라고 할 수는 없다. 더욱이 지금 남북관계는 꽉 막혀 있다. 이런 상황에서 국제법적 및 인권적 접근을 통해 납북자 문제 해결을 위한 이론적 기반으로 활용할 필요가 있다. 또한 유엔 인권이사회, 유엔 북한인권특별보고관 등과 협력하면서, 유엔 강제실종실무그룹(WGEID) 등 관련 국제인권기구의 절차를 이용하는 과정에서 북한의 태도를 납북자 문제 해결에 호응하는 방향으로 바꾸도록 해야 한다. 납북자 문제도 결국에는 확고한 의지를 바탕으로 남북회담을 통해 해결을 모색해야 한다. 구체적으로 납북자의 생사 및 건강상태 확인, 의료 지원, 서신왕래와 상봉 및 송환(남측 가족 재결합)을 단계적으로 추진할 수 있을 것이다. 아울러 납북자 문제가 안고 있는 ‘과거사’ 측면을 고려하여 가해자 처벌 및 피해자 구제에 대해서도 관심을 기울여야 한다. 아울러 정부와 시민사회가 ‘이행기 정의’의 실현을 위해 필요한 조치를 취하는 데도 결코 인색해서는 안 될 것이다.

영문 초록

At present, South Korean abductee issue comes into a global issue the United Nations General Assembly has dealt with since 2005. This matter has complex elements or diverse aspects including kidnapping by state terrorism, enforced appearance, unlawful detention, continued violation of human rights, protection of citizens etc. Against this background, abduction issue can be said to be one of the most difficult problems facing the ROK government in inter-Korean relations. Meanwhile, South Korean government and Korea National Red Cross have made efforts to solve that issue on the humanitarian dimension. But the outcome is not so satisfactory in spite of time and hard toil invested during the past 20 years. Moreover inter-Korean relations are tightly blocked at the moment. In view of such situation, it is quite necessary to introduce international law and human rights-based approach as a theoretical ground for the settlement of abduction issue. In addition, we should change North Korea’s negative attitude toward the subject in the course of cooperation with the UN human rights bodies such as Human Rights Council(HRC), Special Rapporteur on North Korean Human Rights and the like, or of utilizing relevant procedures of individual communication or urgent appeal to Working Group on Enforced or Involuntary Disappearance(WGEID). After all, it is proper to search for solution to the abduction issue through South-North Korean talks with a firm will. For example, we could push forward the identification of fate, whereabout and health condition, medical and other humanitarian assistance, exchange of letters, reunion, repatriation for family reintegration and so on in a phased way. Besides, the ROK government should pay due attention to measures for the punishment of perpetrators and the relief of the victims considering past wrong-doings involved in the North Korean abduction. Like this, it should be proactive in the realization of ‘transitional justice.’
