범법 자폐성장애인의 처우에 관한 연구

국문 초록

본 연구는 범법 자폐성장애인에 대한 법원의 최근 판결을 살펴보고, 이와 관련한 자폐장애 범죄인 처우의 제도적 고찰과 검토를 통해 개별적 처우에 대한 논의의 방향을 제시하고자 하였다. 연구 대상 판결에서 법원은 피고인이 자폐성장애 등으로 심신미약 상태에서 상해죄와 폭행죄를 저질러 심신장애인에 해당하고, 과거의 전력을 통해 재범의 위험성을 인정하였다. 그리고 피고인의 자폐성장애에 대한 치료감호의 제도적 한계를 인식하며 불가피하게 치료감호를 선고하였다. 이 판결의 의미는 법원이 제도의 실상을 살펴보고 법률적 판단을 하였다는데 있다. 자폐성장애인은 관련 법률에 따라 장애인등록과 권리보장을 위한 지원의 대상이 된다. 또한 자폐장애는 사회적 상호작용, 의사소통제한, 상동적 행동, 화내는 기질 및 공격성 등이 동반될 수 있는 발달장애이고, 약물이나 특수 치료를 통한 완치 방법은 없다고 알려져 있다. 자폐성장애인이 범법행위를 하면 장애의 정도에 따라 수사와 공판 과정을 거쳐 치료감호의 대상이 될 수 있다. 범법 자폐성장애인의 처우에 대하여 검토한 바에 따르면, 자폐장애는 정신의학적 또는 심리학적 관점에서 보면 완치될 수 없기 때문에 기간 제한이 있는 치료감호 판결을 선고하는 점은 타당하지 않다. 또한 자폐성장애인이 유형력을 행사하는 경우에 단기간 위탁치료시설의 종사자가 대응하기 곤란하고, 보호자도 자폐성장애인을 24시간 돌보기에 한계가 있다. 그리고 자폐장애 범죄인의 형사사법적 처리 통계 현황이 없어 정책적 필요사항을 판단하기 위한 기초 자료도 부족하다. 따라서, 자폐장애는 완치를 위한 극복의 대상이 될 수 없기 때문에 약물처방에 의한 일시적 증상을 억제하는 치료감호처분은 지양하여야 한다. 그리고 범법 자폐성장애인에 대한 증상 특징을 이해하고 형사 절차와 사회적 서비스를 안내하고 보조할 수 있는 전문보호인력의 양성을 통해 자폐성장애인을 지원할 수 있는 방안이 필요하다. 또한 자폐성장애인의 장애 정도에 따른 형사사법적 처리 현황이 구체적으로 기록 유지되어 형사정책을 위한 기초자료로 활용될 수 있어야 한다. 본 연구는 개별적 사건의 판결문을 통해 제도를 조망하였다는데 그 의의가 있다. 하지만, 자폐성장애인의 범죄 유형과 처우에 대한 개별적 사례를 종합하여 제도의 체계에 따른 기능별로 구체적인 향후 연구가 필요하다.

영문 초록

The purpose of this study is to examine the recent court rulings on autistic offenders, and to present the direction of discussion on the individual treatment of autistic offenders after systematic consideration and review of treatment of autistic offenders. In the ruling under study The court said that the accused person is a Person of Disability of mind and spirit for committing injury or assault in a Mental weakness, Recognized the dangers of repeating crime through past history. In addition, they recognized the institutional limitations of treatment for respondents autistic disorder and sentenced them to Medical Treatment and Custody. This ruling is meaningful in that the court examined the system and made legal judgments. Autistic persons with disabilities are subject to assistance for the registration of persons with disabilities and the protection of their rights in accordance with applicable law. In addition, autism disorder is a developmental disorder accompanied by social interaction, communication restrictions, homology, anger, and aggression, There is no cure through medication or special treatment. If a person with autistic disability commits a crime, it may be subject to Medical Treatment and Custody through investigation and trial. According to a review of the treatment of autistic offenders, Since autism is not curable from the present psychiatric or psychological point of view, it is not valid to pronounce a Medical Treatment and Custody judgment. Also, In case of autism, the workers of short-term foster care facilities are difficult to deal with, and their guardians have limitations in caring for them for 24 hours. There is no basic data for judging policy needs due to the lack of statistics on criminal justice for autistic offenders. Therefore, Autism disorders cannot be the target of overcoming for cure, so treatment that suppresses temporary symptoms caused by drug prescription should be avoided. In addition, it is necessary to understand the characteristics of symptoms for autistic offenders and to develop professional protection personnel who can guide and assist criminal justice procedures and social services. In addition, the criminal justice treatment status according to the degree of disability of autistic persons with disabilities should be specifically recorded and used as basic data for criminal policy.
