영국의 피해자 조사기법 실무교육과 그 시사점 - 포츠머스 대학에서 ABE 가이드에 관한 훈련과정을 중심으로 -

국문 초록

최근 들어 경찰청 등 수사기관에서 피해자 조사기법의 도입･활용에 대한 관심이 높아지고 있다. 그러나 아직까지는 관련 정책 시행의 초기 단계로서 조사기법의 보급･시행에만 초점이 맞추어져 있고, 그 외 실무적 측면에서 조사기법의 전문적인 교육훈련 등을 포함한 다양한 실무적인 쟁점은 전혀 논의조차 되지 않고 있다. 본 논문은 조사기법의 시행으로 우리나라의 실정에 부합하는 체계적인 조사기법의 개발, 전문적인 교육훈련의 실시, 조사관에 대한 체계적인 평가, 정책변화에 따른 부작용 최소화와 같은 문제들을 고민하기 위해 쓰여졌다. 이를 위해 필자가 2018. 9.경 국외훈련연수에 참여한 내용을 토대로 직접 경험했던 교육훈련을 소개하고, 그 과정에서의 시사점을 도출하여 국내의 개선과제로 적용해 본다. 우선 영국에서 체계적으로 발달하였고, 보다 폭넓은 범위의 피해자에게 적용 가능한 조사기법인 소위 ‘ABE 가이드’에 살펴본다. 영국에서는 이미 오래전부터 심리학의 연구성과에 기반하여 피해자에 대한 인지면담기법을 개발하기 위해 많은 노력을 기울여 왔다. 이를 통해 탄생한 ‘ABE 가이드’은 아동･장애인에 국한하지 않고, 취약하거나 겁먹은 피해자들에 대해서도 폭넓게 적용될 수 있는 조사기법이다. 아울러 동 매뉴얼은 최상의 증거(best evidence) 수집을 염두에 두고 각 조사단계가 구성되어있다는 점을 특징으로 한다. 이어서 영국에서 실제로 면담기법 교육이 어떻게 이루어지는 지에 대해서 소개한다. 교육은 사람의 기억이 저장･인출되는 과정에 대한 이해를 바탕으로, 각 조사단계의 중요성과 의미에 대해 설명하는 방식으로 이루어진다. 이어서 현장과 동일한 상황에서의 진술조사 실습과 평가를 통해 교육의 효과를 높이고 있다. 이러한 이론적･실무적 내용들이 우리나라 진술조사 실무에 줄 수 있는 시사점에 대해서도 검토한다.

영문 초록

As the importance of protecting victims is increasingly important in criminal procedure, there is growing interest for the interview techniques to obtain effective and reliable statements from victims. In the late 2000s, many scholars began to study on cognitive interviews, which can be used by police agencies during the investigative process. The investigating agency also has begun to use this technique (so-called “NICHD technique”) in practice, but the changes are not substantial, as expected. Therefore, it is necessary to examine various interview techniques rather than relying on only one interview technique in the investigative practice. By exploring the advantages and disadvantages of each interview technique, it is encouraged to create Korean-style interview technique, which is suitable for the situation and culture in Korea. For this purpose, this study explores the so-called ‘ABE Manual’, which is systematically developed in the UK and applicable to a wider range of victims. In the UK, much effort has been devoted to developing cognitive interviewing techniques for victims based on concrete psychological research results. The ‘ABE Manual’, which was created through this effort, is an investigation technique that can be applied not only to children and disabled people, but also to vulnerable or frightened victims. The manual is characterized by the fact that each stage of the survey is organized with the purpose of producing ‘the best evidence’ in criminal process. Second, this study also introduces how interviewing skill education in the UK actually takes place. First, education is based on an understanding of the process in which people’s memory is stored and withdrawn, and explains the importance and meaning of each stage of ABE interview. In addition, the effectiveness of education is being enhanced through practice and evaluation by the advisor. This study also examines the implications for Korean investigatie system.
