지방분권과 부패 문제의 제주적 특수성과 쟁점

국문 초록

본 연구는 먼저 지방분권과 부패 문제의 관련성을 검토하고, 이미 지방분권이 상당히 이루어진 제주특별자치도를 중심으로 부패 문제를 살펴보았다. 실증적인 연구에서도 지방분권과 부패 간의 상관관계를 찾기는 어렵다. 그러나 지방분권 시대를 맞이하는 입장에서 부패 문제에 대한 우려의 목소리가 크다. 실증적인 연구들에서 지방분권과 부패 사이의 상관관계를 찾기 어렵다고 해도 현재 지방자치단체에서 발생하는 여러 가지 부패 문제를 보았을 때, 지방분권과 부패 사이의 상관관계를 떠나 지방부패의 증가는 지방분권화에 악영향을 미치는 것에는 틀림이 없다. 물론 지방자치단체의 부패방지를 위한 제도가 마련되어 있지만, 충분하다고 보기 어렵기 때문에 기존 제도의 개선과 감사기관의 독립성·전문성 확보 등의 노력이 필요하다. 분권화가 상당히 진전된 제주특별자치도의 경우, 제주도의 지리적 특수성으로 인한 연고주의 부패문제가 심각하다고 할 수 있다. 이를 해결하기 위하여 연고등록제, 모니터링제, 연고집단 금지 제도 등을 강력하게 시행하여야 할 것이다. 제주특별자치도 감사위원회 제도가 긍정적으로 평가받고 있지만, 인사권 독립이나 전문성 확보의 노력도 필요하다. 아울러 지방분권화 시대의 지방부패방지 기구에 대한 조직법적 관심도 필요할 때이다. 독립성이 확보된 지방 부패방지 전담기구의 설치를 제안한다.

영문 초록

The study first examined the relevance of decentralization and corruption issues and focused on the corruption issue in Jeju Special Self-Governing Province, where there has already been considerable decentralization. Even in empirical research, it is difficult to find a correlation between decentralization and corruption. However, there are many voices of concern about the corruption issue from the perspective of the era of decentralization. Even if empirical studies find it difficult to find a correlation between decentralization and corruption, the increase in local corruption, regardless of the correlation between decentralization and corruption, must be detrimental to decentralization. Of course, there is a system in place for local governments to prevent corruption, but efforts to improve the existing system and secure independence and professionalism of audit agencies are needed because it is difficult to see it as sufficient. In the case of Jeju Special Self-Governing Province, the problem of Nepotism due to the geographical features of Jeju Island is serious. To solve this problem, ‘the nepotic registration system’, ‘the nepotic monitoring system’, and the ban on association nepotic groups should be implemented strongly. The audit committee system for Jeju Special Self-Governing Province is evaluated positively, but efforts to gain independence or professionalism are also needed. Also, it is time for the government to take legal interest in local anti-corruption organizations in the era of decentralization. Propose the establishment of an organization dedicated to anti-corruption in provinces where independence is secured.
