시각예술저작물의 차용을 둘러싼 공정이용 판단을 위한 미학적 검토

국문 초록

저작물의 이용을 둘러싼 공정이용의 법률적 판단에서 가장 중요한 요인은 변형적 이용의 여부이다. 그러나 변형성 기준은 시각예술에 대한 법원의 모호한 태도의 주요 원인으로, 특히 공정이용 형량의 대상이 차용적 성격을 갖는 경우에는 그 법적 판단이 더욱 각양각색이라는 비판들이 제기되어 왔다. 본고에서는 시각예술저작물의 차용을 둘러싸고 미연방저작권법상의 § 107 혹은 제107조 공정이용 규정의 적용과 해석에 있어서 그 판단의 모호함의 원인이 되고 있는 제1기준 저작물 이용목적의 변형성 검토객체에 관한 문제, 변형성 판단의 주체에 관한 문제, 그리고 공정이용으로 보호하는 저작물의 차용의 범주 확장의 필요성을 중심으로 이들 문제의 해소를 위한 논의를 시도하였다. 본문에서의 논의는 예술의 창작기법으로 활용되고 있는 차용의 미학적 본질에 대한 이해 제고를 위해 예술적 관점으로부터의 인유적(引喩的) 접근을 통해 전개하였다. 우리나라 저작권법도 미국의 공정이용 조항과 유사한 법리를 도입하고 있어 본 주제 관련하여 국내에서도 각별한 관심으로 검토해 갈 필요가 있다.

영문 초록

The most important factor in the legal assessment of the fair use of copyrighted works is transformative use. The criteria for determining transformativeness, however, have been pointed out as a main cause of the ambiguous attitude of the courts toward visual arts. In particular, there have been many criticisms that legal judgments vary considerably when those subject to sentences for violations of fair use are of the nature of appropriation. This study examined the causes of ambiguous judgments in applying and interpreting the provisions of fair use in Section 107 of the U.S. Copyright Act regarding the act of appropriating visual art works, focusing on problems raised in determining objects of which transformativeness in the primary purpose of the use of copyrighted works needs to be considered (the first factor in fair use determinations); subjects of which perspective needs to be mainly considered in judging transformativeness; and the necessity of expanding the category of appropriation types to be protected as fair use. This study also attempted to discuss measures to address these problems, and adopted an allusion approach from an artistic perspective for a better understanding of the aesthetic nature of appropriation utilized as a technique of creating works by imitation. Since the Korean Copyright Act also introduced similar legal principles to the fair use articles of the U.S. Copyright Act, it is necessary to pay particular attention to and review this topic in Korea.
