보복형 성적촬영물 관련 범죄 처벌의 문제점과 개선방안

국문 초록

보복형 성적촬영물은 인터넷을 이용한 전파성으로 인하여 한번 유포된 경우 영구적으로 삭제하는 것이 거의 불가능하다고 할 수 있다. 더욱이 과학기술의 발달로 촬영 및 유포의 수단과 방법은 진화하고 있지만 이를 규제하는 법과 제도가 이에 따라가지 못하고 있으며 적절한 대응책을 강구할 필요가 있다. 이러한 문제의식을 토대로 정부, 입법기관, 사회 각계각층에서 대책마련을 위하여 노력하고 있지만 아직 미흡한 부분이 적지 않게 남아있다. 현재 보복형 성적촬영물 관련 범죄는 성폭력처벌법을 통해 규제되고 있으나, 보복형 성적촬영물과 관련된 위법 행위를 포괄하지 못하며, 처벌상의 흠결이 발생하고 있다. 이에 본 연구에서는 디지털 성폭력 중 피해 현황과 증가 추세에 비하여 법적·제도적인 대응이 불충분하다고 여겨지는 보복형 성적촬영물 관련 처벌의 문제점과 개선방안을 찾기 위하여 우선 그 실태와 특징을 파악하고, 현행법상 처벌규정에 관하여 검토하겠다. 그리고 이러한 문제에 대처하기 위하여 특별법을 제정하였으며 우리와 유사한 법체계를 가진 일본의 ‘사사성적 화상기록(Private Sexual Image Record)의 제공 등에 의한 피해의 방지에 관한 법률’의 제정 배경·경위 및 내용 등에 대해 검토하고 시사점을 도출하고자 한다. 마지막으로 이러한 검토 결과를 토대로 현행법의 문제점을 해결하기 위한 방안을 제안하도록 하겠다.

영문 초록

If a revenge porn clip is once distributed, it is almost permanently impossible delete it, due to its transmission using other internet channels. Moreover, although measures and methods for filming and circulation have evolved, laws and institutions for regulating them cannot catch up with them, so it is necessary to seek for proper countermeasures. Based on such critical mind, the government, legislative organs and various social classes have underwent efforts to develop solutions, but many unsolved problems still remain. Although crimes related with revenge porn are regulated by the sexual violence act, it does not include offenses related with revenge porn and deficiency in punishment appears. This study would, therefore, understand the conditions and characteristics of revenge porn and review punishment regulations under the existing law, in order to seek out problems and improvement of punishment on revenge porn for which legal and institutional measures are thought to be inadequate, compared with damage and growing trend of digital sexual violence. To tackle such a challenge, a special law was enacted. This study attempts to examine the background, procedures and contents of enactment of a low for protecting damage and then draw some suggestions, from Private Sexual Image Record provided by Japan with the low system similar to that of Korea. Finally, it would suggest some measures for solving the problems of the existing law, based on such results of the review.
