혼인 무효 선언 소송에서 방어권 거부로 인한 판결의 보정될 수 없는 무효

국문 초록

현행 교회법 제1620조 제7호는 방어권 거부로 인하여 판결이 보정될 수 없는 무효가 된다고 명시한다. 방어권 거부로 인한 판결의 보정될 수 없는 무효는 혼인 무효 선언 소송에서도 발생할 수 있다(훈령『혼인의 존엄』 제270조 제7호). 특히 혼인 무효 선언 소송은 교회의 공익과 신자들의 사익이 깊이 연루되어 있다. 혼인의 유효나 무효 곧 혼인 유대의 유무를 확인하는 일은 유효인 혼인의 불가해소성을 천명하는 교회의 가르침과 밀접하게 연관되어 있고, 배우자들의 신분(status)을 명확히 하는 일은 배우자 자신들의 소명과 사명 그리고 구원과 밀접하게 연관되어 있기 때문이다. 이처럼 중요한 사안을 다루는 소송이기에, 교회는 혼인 유대의 유무와 신자들의 신분에 대한 객관적 진실을 규명하는 데에 필요한 변증법적 절차와 변증법적 합리성을 담보하고자 한다. 반론(대립)이 없는 공정한 재판이란 생각조차 할 수 없기 때문이다. 다시 말해, 각자 자기의 의견을 말하고, 상대편이 제출하거나 직권으로 제출된 주장과 증거와 논증을 알고서 이를 반박할 구체적인 기회가 각 당사자에게 부여되지 않는다면, 공평한 재판이 될 수 없기 때문이다. 특히 혼인 무효 선언 소송에는, 사안의 진실은 항상 보존되면서, 혼인의 유대에 유리한 증거와 답변과 항변이라면 어떤 종류의 것이든지 제기해야 할 성사 보호관이 반드시 관여해야 한다. 따라서 성사 보호관에게도 합당한 방어권이 보장될 수 있어야 한다. 교회는 객관적 진실을 규명하려는 목적에서, 판정을 내리는 임무만이 아니라 소송 절차를 진행하는 임무도 제삼자(super partes)인 재판관에게 맡기면서, 이해 당사들이 각자 ‘자신의 진리’를 말하고 ‘상대방 당사자의 진리’를 알고서 반박할 수 있도록 합당한 기회를 보장해주게 한다. 재판관은 법률이 자신에게 준 재량권을 사용할 때, 성사 보호관을 포함하여 당사자들의 방어권을 침해하지 않도록 주의하여야 한다.

영문 초록

The Code of Canon Law now in force explicitly sanctions in canon 1620, 7° irremediable nullity of a sentence due to the denial of the right of defense. The violation of the right of defense may also arise in causes for the declaration of the nullity of marriage(『Dignitas Connubii』 art. 270, 7°). In particular, these causes are deeply involved in the public good of the Church and the private good of the faithful. Verifying whether a marriage is valid or invalid, namely whether exists the conjugal bond or not is closely linked to the teachings of the Church who proclaims the indissolubility of the valid marriage, and clarifying the status of spouses is closely linked to there own vocation, mission and salvation. Therefore, the Church seeks to ensure the dialectic of the proceedings and the dialectic of the rationality, which are necessary to establish objective truths about the existence of conjugal bond and the status of the faithful. One cannot conceive of a just judgment without the contention (contradittorio), that is without the concrete possibility granted to each party in the case to be heard and to be able to know and contradict the requests, proofs, and deductions adopted by the opposing party or ex offcio. Specially, in causes of the nullity of marriage the presence of the defender of the bond is always required, who is bound by the obligation to propose any kind of proofs, responses and exceptions that, without prejudice to the truth of the matter, contribute to the protection of the bond. Therefore, the right of defense must be guaranteed also to him. The Church entrusts to the judge (super partes) not only the duty of making a judgment but also the duty of directing the proceedings, ensuring a reasonable opportunity for each of the interested parties to state “his or her own truth” and contradict “truth of the opposing party,” in order to ascertain “objective truth”. When a judge uses the discretion given to him by law, he must be careful not to violate the person s right to defend himself.
