제주특별자치도의 영리병원허가에 관한 법적 쟁점

국문 초록

제주특별법에서는 외국인 관광객 유치로 인한 의료관광산업활성화로 고용을 창출하고 지역경제를 활성화하고, 의료서비스 질의 제고 등을 위하여 제주특별자치도에 설립된 외국법인에게 의료법에서 금지하고 있는 영리성을 추구하게 하여 이익을 분배할 수 있는 영리의료법인의 개설허가를 허용하고 있다. 제주특별법에서는 보건의료정책심의위원회의 심의를 거쳐 외국인영리병원에 대한 개설허가권 제주특별자치도지사에게 부여하고, 제주특별자치도지사의 열리병원허가전에 보건복지부장관은 승인을 얻도록 하고 있고 그밖에 영리병원에 관한 사항은 도조례로 정할 수 있도록 하고 있다. 다만, 영리병원은 국민건강보험법에 의한 요양기관이나 의료급여기관에서 제외하여 건강보험체계의 근간이 훼손되지 않게 하고 있다. 영리병원에 관한 법적 쟁점을 입법자의 재량에 속하는지와 입법자의 입법재량의 한계 문제를 검토한다. 또한 제주특별법과 제주특별자치도 보건의료특례 등에 관한 조례에서는 영리병원개설허가 신청권자를 외국법인(주식회사, 유한회사에 한함)에 한정하고, 우리나라의 법인이나 의료인에게는 영리병원개설을 허용하지 않아 헌법상 보장된 직업선택의 자유의 한계를 넘었는지를 검토한다. 또한 제주특별자치도지사가 보건정책심의위원회의 심의결과에 따라 제주특별법이나 제주특별자치도 보건의료특례 등에 관한조례에서 명문으로 내국인진료를 금지한다는 근거가 없는데도 행정행위의 부관(조건)를 붙여 외국인전용병원으로 개원할 것을 내용으로 하는 행정행위부관이 위법한 지를 검토한다. 제주특별자치도의 영리병원개설허가에 대한 주민간의 갈등이 심화된 사안이므로 계획수립 전단계부터 허가 시까지 주민들의 참여가 보장되는 방안을 검토한다.

영문 초록

The Jeju Special Law was established in the Jeju Special Self-Governing Province to create jobs for the vitalization of the medical tourism industry due to the attraction of foreign tourists, revitalize the local economy, and improve the quality of medical services. It permits foreign corporations to establish a for-profit medical corporation that can distribute profits by pursuing Yoonrison, who is prohibited in medical practice. According to the Jeju Special Law, after the deliberation of the Health Policy Committee, the right to open a foreign for-profit hospital is granted to the governor of Jeju Special Self-Governing Province. Approval is obtained, and other matters related to profit-making hospitals can be determined by the road regulations. However, for-profit hospitals are excluded from medical institutions and medical benefit institutions under the National Health Insurance Act to prevent damage to the health insurance system. The question of whether the legal issues of a for-profit hospital belong to the legislator s discretion and the limits of the legislator s legislative discretion. In addition, the Jeju Special Law and the Ordinance on Medical Exceptions for Jeju Special Self-Governing Province restrict applicants for establishment of for-profit hospitals to foreign corporations (limited to corporations and limited companies), and profits to Japanese corporations and medical professionals. Consider whether you have exceeded the limits of freedom of choice for occupations that are not constitutionally permitted to open hospitals. In addition, there is no basis for prohibiting Korean medical treatment in the prestigious prescriptions of the Jeju Special Self-Governor Governor based on the results of deliberation by the Medical Policy Council, and the ordinances regarding the Jeju Special Law and the Jeju Special Self-Governing Medical Special In addition, I would like to consider whether an administrative deputy officer whose contents include opening a hospital dedicated to foreigners with an administrative deputy officer (condition) is illegal. Considering that the conflict between residents in the permission to open a commercial hospital in Jeju Special Self-Governing Province has become serious, it is considered that the participation of residents is guaranteed until the permission from the pre-planning stage.
