국문 초록

EU의 난민 유입 원인은 과거 경제적 이유에서 중동과 아프리카 국가의 정세변화로 인한 난민유입으로 변화하였다. 난민의 유입을 물리적으로 막는 것은 현실적으로 쉽지 않다. 과거에는 난민 해결은 특정국가의 문제였지만, 현재 EU의 난민위기는 전 유럽의 공통과제이다. 또한 기존의 국가 단위의 문제에서 지역단위 문제로 변화하고 있다. 이 때문에 EU가맹국 사이의 난민 유입의 불균형을 시정하고 망명으로 인한 국가적 부담을 평균화하고, 망명기준의 격차의 해소, 보호수준을 동일하게 하기 위하여 유럽공통망명제도(Common European Asylum System)의 구축과 변화가 있어야 한다. 본 논문에서는 EU에서 난민의 대량유입에 따는 EU공통의 법적과제로 난민에 대한 망명절차에 관한 규정인 유럽공통의 망명제도와 난민의 유입 루트 관리에 해당하는 국경관리에 관한 규정인 Schengen 협약의 전반적 내용과 변화에 대하여 검토하고자 한다.

영문 초록

A cause for the influx of refugees into EU was changed from an economic reason in the past to a situational change in the Middle East and African countries. It is not realistically easy to physically prevent the influx of refugees. A solution of refugees in the past was a matter of a specific nation. However, the current EU refugee crisis is a common task of the whole Europe. Also, it is changing into an issue of the local unit from an issue of the conventional state unit. Owing to this, the Common European Asylum System needs to be implemented and changed in order to correct the imbalance of the refugee influx among EU member countries, to even off a national burden caused by asylum, to bridge the gap in the standard for asylum, and to equalize a protection level. This study aims to examine about the Common European Asylum System, which is the regulation pertinent to asylum procedure concerning refugees, and about the general contents of Schengen Convention, which is the provision regarding the border control of corresponding to the refugee-influx route management, as a common EU legal task according to the mass influx of refugees into EU.
