국회의원 중대선거구제의 장단점과 평등선거의 원칙 -최근 논의의 문제점과 개선방향-

국문 초록

본 논문은 중대선거구제의 장단점 논의를 평등선거의 원칙에 따라 재검토하고 최근의 국회 논의과정에서 제시된 선거구제 관련 각 대안을 비판적으로 고찰한 다. 평등선거의 원칙은 중대선거구제에 대한 평가에 있어 다음과 같은 두 개의 기준을 제시한다. 하나는 널리 알려진 대로 ‘선거구간 인구편차의 최소화’라는 기준이다. 그리고 최근의 연구에 따라 유권자 개인의 투표가 선거결과에 ‘비례적’ 으로 영향을 미치는지 여부, 다시 말해 ‘성과가치의 비례성’이 선거구제의 평가 기준이 될 수 있다. 인구편차와 성과가치의 비례성이라 기준에 따른다면 기존의 중대선거구제에 대한 장단점 논의는 다음과 같이 다시 정리된다. 첫째, 중대선거구제는 ‘유동선거 구’를 도입함으로써 선거구간 인구편차를 최소화할 수 있는 장점을 가진다. 다만 입법자의 의도에 따라 선거구획정시 도리어 중대선거구제로 인하여 선거구간 인구편차가 늘어날 가능성이 전혀 없는 것은 아니다. 둘째, 중대선거구제는 성과가 치의 비례성 제고에 도움을 줄 수 있다. 다만 이러한 장점은 선거구의 크기가 커질수록 강화되므로 대체로 중선거구제가 아닌 대선거구제의 도입을 통하여 보다 분명하게 기대될 수 있다. 작년 말 국회에서는 일종의 절충형 중대선거구제라 할 수 있는 도농복합 선거 구제의 도입을 고려한 바 있다. 그런데 당시의 중대선거구제 대안은 다음의 이유에서 결코 평등선거의 원칙에 부합하는 장점을 인정할 수 없는 것이었다. 첫째, 국회의 대안은 유동선거구제를 전혀 염두에 둔 것이 아니어서 인구편차의 최소화 또한 기대할 수 없는 것이었다. 도리어 이는 의원정수의 확대를 막기 위해 현행 소선거구제보다도 선거구간 인구편차를 증가시키는 안이었다. 둘째, 당시의 대안은 성과가치의 비례성 제고를 기대할 수 있는 대선거구제가 고려되지 아니하였고 거대 정당에 유리한 중선거구제의 도입이 논의되었을 뿐이었다. 중대선거구제가 원론적으로는 평등선거의 원칙에 부합하는 제도적 장점을 가짐에도, 실제 논의된 구체적 대안이 반대의 문제점을 가지게 된 것은 다음의 사정에 기인한다. 국민여론상 전체 의원정수의 확대가 곤란하다. 따라서 선거구획 정에 있어 인구라는 기준과 지역대표성이라는 기준이 충돌한다. 이에 사실상 헌법재판소의 기준 내에서 지역대표성이 우선시되었다. 그러나 선거구획정에 있어 인구라는 요소는 평등선거의 원칙에 근거한 헌법상 기준임에 반하여 행정구역이라는 요소는 단지 법률상의 기준에 불과하다. 따라서 국회는 헌법재판소가 제시한 인구편차 기준을 준수하는데 안주할 것이 아니라, 보다 적극적으로 인구라는 요소를 충실히 반영할 수 있는 선거구획정을 위해 노력하여야 할 필요가 있다. 나아가 보다 장기적인 관점에서 중대선거구제의 장점을 살린 제도의 개선을 위하여 각각 선거구간 인구편차의 최소화와 성과가치의 비례성 제고에 효과적인 유동선거구와 대선거구제에 대한 심도 깊은 고민을 병행하여야 할 것이다.

영문 초록

According to scholars research, in the light of the principle of equal election, a major constituency system can be considered as a better alternative than single-member constituency system. First, a major constituency system has the advantage of minimizing the population gap in electoral districts compared to a single-member constituency system by providing a floating district in the multi-member district. Second, as the size of the district increases, the proportionality of voting value also increases. Scholars suggest that the proportionality of voting value also increases in the electoral district where more than five people are elected. By the end of last year, the National Assembly has considered the introduction of the urban and rural complex election district system, which can be called the multi-membered district system. However, the electoral system discussed at the time was never advantageous, according to the principle of equality election, for the following reasons. First, the proposal did not consider more than five electoral districts, which are expected to increase the proportionality of the voting value. Second, the proposal at the time was to increase the population gap in the election district rather than the current single-member election system. For legislators, it was necessary to reduce the number of district assembly members due to the expansion of proportional representation system. This problem is due to the fact that the criteria of population and administrative district conflict with each other in the demarcation of the precinct. But the element of population is a constitutional standard, whereas the element of administrative district is only a legal standard in redistricting. Therefore, the National Assembly should strive for the demarcation of the population that minimizes population variation. From a longer-term standpoint, it will be also necessary to consider the introduction of floterial districts system.
