교육감 주민직선제 개편 관련 개정 법률안 비교 연구

국문 초록

이 연구는 교육감 주민직선제 도입 이후 동 제도 개편을 위해 발의된 개정 법률안을 비교분석하여 그 특징과 실현 가능성 등을 드러냄으로써 향후 입법과정에 도움을 주려는 목적에서 마련된 것이다. 연구결과는 다음 몇 가지로 정리해볼 수 있다. 첫째, 주민직선제 개편론 대두의 직접적인 원인은 낮은 투표율과 선거비용 문제였다. 둘째, 2006년 12월 주민직선제 도입 시 야기된 제도 설계의 불균형 문제와 ``진보교육감``의 등장 이후 당락에 관한 정치적 타산이 제도 개편을 추동하는 요인으로 작용하였다. 셋째, 총9개의 법안은 ⑴ 확대된 간선제, ⑵ 조례에 의한 선택제, ⑶ 시·도지사 임명제, ⑷ 시·도지사와의 러닝메이트제 등 네 가지 유형으로 분류할 수 있는데, 그 순위를 말하기는 어렵지만 ⑶과 ⑷의 실현 가능성이 비교적 높은 것으로 분석되었다. 넷째, 향후 필연적으로 전개 될 입법과정이 또다시 시간에 쫓기게 될 공산이 큰 까닭에 하루라도 빨리 모든 가능성을 열어놓고 국민적 합의를 도출하는 노력을 기울여야 한다는 점을 확인할 수 있었다.

영문 초록

This study aims to reveal the characteristics and the possibilities of revising bills of the direct superintendent election system to help expected future legislative activities. For this, the author adopts the comparative analysis of the 9 bills, which can be classified four types. In addition to this, it is important for the author to examine the political process of introducing the direct superintendent electoral system and the causes of rising the opinion of changing it. The results of this study are as follows. First, it is a light turnout of superintendent election that is the direct cause of rising the opinion of changing the electoral system. Second, another causes of it are the unbalanced design of electoral system, which is caused by a legal revision on December 20th 2006, and the political consideration of success or defeat at the polls. Third, the bill of introducing a running mate system seems to have the most feasibility among four types of alternative. Fourth, though we don`t have enough time, it is necessary to seek national consensus on reorganizing the electoral system.
