인성과 인성교육에 관한 헌법적 고찰

국문 초록

본 논문은 헌법의 이념과 가치를 기반으로 인성 개념을 정립하고 인성교육진흥법의 인성교육 등 정의규정을 비판적으로 검토하고자 한다. 헌법의 최고이념은 인간의 존엄성이다. 인간의 존엄성이란 인간의 본질로 간주되는 존귀한 인격의 내용을 이루는 주체성과 공동체성이라고 정의할 수 있다. 이에 비춰 인성 개념을 정립한다면 인성이란 인간의 존엄성을 구현하는 주체적이고 공동체적인 성품과 역량을 말한다. 인성교 육진흥법상의 인성교육 관련 정의는 위와 같은 인성 개념을 바탕으로 헌법의 이념과 헌법적 가치가 제대로 실현될 수 있도록 규정되어야 한다. 이러한 문제의식 하에 인성교육진흥법이 규정하고 있는 인성교육, 핵심 가치·덕목, 핵심 역량 등 정의에 대해 비판적으로 검토하고 대안을 제시해 본다.

영문 초록

Although the Character education promotion act is enforced, there is so much confusion about directions and contents of a character education in the education field. The most important reason is that the concept of a character is not established clearly. But it is not easy to establish the concept of a character firmly. The concept of a character should be established on the basis of the human dignity, because the human dignity is the highest ideology of the Constitution of the Republic of Korea. The human dignity can be defined as autonomous reason and social morality which constitute the contents of honorable personality. In short, The human dignity is humanity. The Constitution doesn``t design subjective human beings nor communal human beings. The Constitution designs subjective and communal human beings as the constitutional human beings. With the constitutional point of view, ideal human beings are subjective and communal human beings, who realize the human dignity. The word of ecological metaphor expresses this human beings is a ssiol and a ssiol is a trademark of Ham, Seok-heon``s thought. Definition provisions regarding character and character education etc in the Character education promotion act should be prescribed to realize the constitutional values on the basis of the constitutional human beings. I try to make new definitions about a character, a character education, core values, core virtues, core abilities. A character is subjective and communal natures and subjective and communal competences to relize the human dignity. A character education is a education for the purpose of cultivating a character. Core values are the constitutional values such as the human dignity, liberty, equality, democracy, the rule of law, respect for basic human rights. core virtues are wisdom, courage, temperance, humanity, justice, transcendence. Core abilities are cognitive and emotional and behavioral abilities to practice core values and core virtues actively.
