법치행정 구현을 위한 마중물로서 변호사의 공직 진출 확대 방안

국문 초록

한 국가의 어떤 제도나 정부의 행위가 정당성을 확보하기 위해서는 기본적으로 법에 근거를 두어야 하나 단순히 법적 근거가 있다는 것으로는 부족하고, 해당 법률과 행정입법은 헌법과 상위 법률에 위반되지 않아야 한다. 그런 이유로 특정 법률과 법령의 제정은 물론 그 법령에 근거한 정책의 입안과 집행 등 모든 단계에서 실질적인 법치주의가 구현될 수 있도록 하기 위해서는 관련 법률의 전문가가 직, 간접적으로 관여할 필요가 있다. 현재 중앙정부는 물론 지방자치단체는 급증하는 법률문제의 발생 원인이 법률전문가 공무원의 부재에 기인하는 점을 어느 정도 숙지하고 있으며, 문제 발생 이후 이를 해결하는데 있어 법률 전문가의 부족을 절실하게 경험하고 있다. 문제는 그러한 인식에도 불구하고, 부처 이기주의나 일반직 공무원의 눈치, 그리고 예산배정의 한계로 변호사 자격있는 공무원 채용은 획기적으로 늘지 못하고 있다. 시민들을 위한 좋은 행정을 펼치고, 그 바탕으로서 법치주의가 확립이 되기 위해서는 변호사 자격있는 법률전문가가 공직 등에 폭넓게 진출할 필요가 있는 당위성은 어떤 말로도 부족하며 그를 확실히 뒷받침하기 위해서는 실질적인 법제도 및 이를 뒷받침할 수 있는 구체적인 예산의 배정이다. 다만, 중앙행정기관과 지방자치단체에 변호사 자격자를 법무담당관 등으로 채용하는 것이 단순히 변호사 직역의 자리를 늘리기가 아니라는 점을 정치권은 물론 국민전체로부터 공감을 얻어야 한다. 이에 실질적 법치주의 실현이 위법한 행정행위를 사전에 차단하여 국민 모두에게 유익하다는 점을 보다 적극적으로 홍보할 필요가 있는바, 학계와 관련 부처로서 법무부, 로스쿨, 변호사회 등의 노력이 절실히 필요하다.

영문 초록

The maturity of democracy and rule of law may require various factors, but the realization of democracy and rule of law in the system and the realization of democracy and rule of law in the process are of the utmost importance. In order to ensure the legitimacy of any institution or administration s action, it is basically based on the law and it is not enough that there is simply a basis for the law. Because wrong statutes are fatal to the people, legal experts must be directly involved in the policy making and enforcement process of the government and local authorities so that substantive legalism can be implemented at all stages of the policy. At present, local governments as well as the central government are aware of the fact that the cause of the rapidly increasing legal problems is caused by the absence of legal professional officers, and above all, And experience it seriously. In spite of such recognition, the problem sees the limitation that it can not increase the recruitment of qualified individuals who are qualified as lawyers, while acknowledging the necessity due to the selfishness of the government, the public officials, and above all the limit of budget allocation. In the end, in order to achieve good administration for the citizens and to establish the rule of law as a basis, it is necessary to have a lawyer qualified lawyer to enter a wide range of public offices. In order to be sure, I can say that it is a specific budget allocation that can be done. In addition, the election of a lawyer as a lawyer in the central administrative or local government should not simply increase the number of lawyers. The efforts of local lawyers associations and Korean lawyers associations such as the National Assembly, academia, the Ministry of Justice, the Seoul District Attorneys Association, etc., are urgently needed to realize that the actual realization of the rule of law in the administration is effective for all citizens by preventing illegal administrative acts in advance .
