The causes for real estate transaction accidents include the disapproval of public confidence in registration due to the principle of perfunctory screening, the existence of right relations unregistrable at the public ledger, the dualization of the incomplete cadastral system and the official notice system, a risk of immediate payment for real estate transaction, the perfunctory writing of the identification statement on the object of brokerage, transaction fraud, complicated restriction on real estate and the like. And real estate transaction accidents can be divided into those in legal, economic, technical and distribution terms. The real estate transaction accident prevention system can be divided into the can be divided into the prior prevention system and the post hoc prevention system. in conformity to Sec. 30(guarantee of liability for damages) of 「 Act on the Works of the Licensed Real Estate Agent and the Notification of Real Estate Transactions」 Article 30, corporate agents should deposit more than 200 million won in the guarantee insurance, the benevolent fund and the benefit body.\ in order to compensate for damages due to real estate transaction accidents. And those except the firm should deposit more than 100 million won. To prevent real estate transaction accidents in advance rather than the method of relief after their occurrence, the escrow system generally used in the US was introduced to Korea a few years ago and has not still taken root in our society. And seeing real estate contains a potential risk in its transaction, it is more necessary to revitalize the prior prevention system. An attempt was made to make an empirical analysis to revitalize the escrow system. As a result, the following findings were obtained: First, it was found that the legal transaction accident, of the types of accidents, occurred most. Second, it was found that the reason for the escrow system to have failed to take root was the lack of measures for both broker and trader to legally institutionalize the reduction of the transfer tax and the like. And the tax benefit is needed. It was found that the time of transaction, the cases of transaction, accident experience and the like had an effect on the intention to use escrow service. And this study presented the following scheme for revitalization of the escrow system. First, it is necessary to publicize the escrow system actively. Second, it is necessary to use the escrow system in case of the comparatively long period of real estate transaction. Third, it is necessary to improve the scheme to revitalize the escrow system by legally institutionalizing the application of an additional discount to its multiple users, the reduction of the transfer tax and the like.
