캘리포니아와 플로리다 주 등에서 부부공동소유권과 일반공동소유권에 대한 소고

국문 초록

미국의 부동산제도에서 공동소유권이란 두 사람이나 그 이상의 사람들이 다양한 방법에 의하여 부동산을 공동으로 소유하는 권리를 말한다. 위와 같은 부동산에 대한 공동소유권은 동일한 부동산에 다수인이 소유를 하고 있기 때문에 분쟁의 소지도 많고 공동소유권자를 위한 제도적인 보호장치는 더욱 필요하다고 할 수 있다. 그러나 우리나라는 공동소유권에 있어서 생존배우자의 보호미비, 공동부동산에 대한 분할의 문제, 배우자부동산의 매각문제 그리고 생존승계권 등의 제도적인 미비로 많은 문제가 발생하고 있다. 그런데 미국의 부동산에 있어서 공동소유권제도는 다양한 법 제도와 공동소유권의 취지에 맞추어 공동소유권자의 권리 보호와 안정성을 위하여 다양하고 정교하게 많이 발전되어 왔다. 따라서 본 연구에서는 우선 캘리포니아와 플로리다 주 등에서 채택하고 있는 부부공동소유권을 검토하기 위하여 부부사이에 부동산소유권이 인정되기 위한 특징을 관습법상 살펴보고, 이어서 부부공동소유권의 형태와 이에 대한내용을 살펴보도록 한다. 그리고 이어서 일반공동소유권 중 공유소유권(Tenancy in Common)과 합유소유권(joint-tenancy)에 대한 내용을 검토하여 공동소유권자의 권리를 보호하고 법적안정성을 기하고자 한다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES In the U.S. real estate, Concurrent Estates is the right of two or more people to the real estate jointly. Concurrent estate is often disputed because many people own the same property. However, there are many problems in Korea due to the lack of institutional support for Concurrent Estates (or Co-tenancy, Co-ownership). In the U.S. real estate, the concurrent estates system protects the rights of the Concurrent Estates in various and sophisticated legal systems and ensures legal stability. Therefore, in this study, we first look at the form of marital property and its contents in order to review Marital Property of US Realty. The purpose of this study in the concurrent estates in the american real estate, we will examine the tenancy in common and joint-tenancy among the general concurrent estates of US real estate to protect the rights of the concurrent estates and to make legal stability. (2) RESEARCH METHOD The methodology is to analyze and investigate major foreign literatures and supreme court precedents and case law in order to suggest any problems and improvement plans. (3) RESEARCH FINDINGS In Korea, if one spouse is killed, there is no Right of Survivorship like the United States, so a measure is needed to protect the spouse. And, Korea has been able to dispose of it without the consent of the other spouse(Article 830 of the Civil Act, etc), so there are a lot of problems. 2. RESULTS Korea should also protect its surviving spouse by reviewing the system of Right of Survivorship in the United States. This study proposed that if you have registered your ownership with one of your spouses, you should review the Community Property so that you can sell it with the consent of all your spouses and sign it. In doing so, they should have equal rights and stable care for all of their spouses.
