국문 초록

본 연구의 목적은 2020년 7월 1일 이후에 발생되는 장기미집행 도시ㆍ군계획시설 중 도시공원의 일몰제에 대비하여, 본 연구에서는 AHP 분석을 통한 장기미집행 도시공원의 일몰제로 인한 문제점의 상대적 중요도를 파악하고, 이에 따른 해결방안을 제시하고자 한다. 본 연구결과에 대한 요약은 다음과 같다. 상위분류 항목에서는 현행 재산권손실 측면에서의 문제점이 상대적으로 가장 중요한 것으로 나타났고, 하위분류 항목에서는 재산권손실 측면의 문제점에서는 토지소유자 매수와 보상 미집행시 손실재정 지원과 사유재산권 제한 또는 사유재산권 침해가 중요하게 나타났다. 또한 법률(제도)적 측면의 문제점에서는 매수청구 신청시 타당한 보상기준적용과 현행 장기미집행 도시공원 관련 상세 법령의 미흡한 것이 중요하게 파악되었다. 마지막으로, 재정적 측면에서의 문제점은 재원이 없거나 확실한 재원조달방안이 마련되지 않은 상태에서 도시계획시설로 수립함과 더불어 매수청구를 수용하지 못한다면 건축허가 처분을 결정할 수밖에 없으므로 장기미집행 도시계획시설의 해제를 간소화하여 공공복리 증진 및 사유재산권에 대한 제도개선이 제일 필요함을 확인하였다.

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this study is to identify the relative importance of Problems due to the Abolition System in a the long - term unexecuted Urban Park through the AHP analysis. (2) RESEARCH METHOD This study employed the AHP analysis to achieve the major objectives of this study. (3) RESEARCH FINDINGS The implications of this study are as follows. This study was conducted to analyze the relative importance of long - term unplanned city planning system by applying AHP statistical analysis using 1: 1 individual interview questionnaire for professionals who have worked for less than 5 years and 20 years or more. There is a great deal of suggestion in understanding the urban planning system. 2. RESULTS The results of this study are summarized as follows. In the upper category, the factors in terms of current property loss are relatively most important. In terms of property rights loss, it is important to finance landlord purchase, compensation for loss in case of non - compensation, and restriction of private property rights or infringement of private property rights. In terms of the legal (institutional) aspect, it was found that it is important to apply reasonable compensation standard when inserting the purchase request and insufficient detailed laws on the current long - term unplanned city planning facility. Finally, the financial aspect is that it is established as a city planning facility with no financial resources and no reliable financing plan, and if it can not accept the purchase request, And that the improvement of public welfare and the improvement of private property rights are the most necessary.
