국문 초록

광주와 5.18은 이미 한국의 유산이 아닌 아시아, 세계의 유산이다. 광주인 권헌장은 이러한 광주의 가치를 선명하게 보여주고 천명한다. 특정한 지역이나 집단이 대상이 아닌 인류 보편의 가치를 담고 있다. 특히 인권을 생각할때 지나칠 수 없는 사회에서 소외받는 이들에 대한 고려가 도드라진다. 이러한 의미에서 전형적 사회적 약자인 청소년배달노동자는 광주인권헌장의 가치가 절실히 적용되어야 할 대상이라고 할 수 있다. 청소년배달노동자는 신체·사회적으로 아직 보호받아야 할 대상으로 배려와 관심이 필요한 대상이다. 특히 헌법과 각종 노동관련 법은 그들의 노동을 아동 노동으로 규정하여 특별히 보호받아야 한다고 규정하고 있다. 그럼에도 오히려 착취와 무관심 속에 신음하고 있는 것이 현실이다. 대부분 영세사업장에서 종사하는 그들은 상시근로인원 5인 미만이라는 노동자로서 최소한을 규정한 근로기준법의 사각지대에 놓이는 경우가 다반사다. 각종 위험 속에서 오토바이 배달을 하기도 한다. 당당한 한 사람의 노동자임에도 ‘아르바이트’라는 의미 불명의 호칭 속에서 그 권리를 박탈당하고 있다. 특히 근래 고용구조의 심각한 외곡을 발생시키고 있는 특수고용이 음식배달업에도 도입되기 시작하면서 그나마 최소한도로 유지되었던 근로자성마저도 박탈당할 위기에 처해 있다. 최저임금을 겨우 웃도는 수준의 임금을 받으면서도 초과근무수당이나 주휴수당 등은 생각할 수도 없고 그나마 근로 중 발생하는 다양한 문제 때문에 임금이 깎이지 않으면 다행으로 생각하기도 한다. 밀린 배달 때문에 과속을 하다 사고가 나면 산재보험은커녕 일을 그만 두어야 할지도 모른다는 걱정에 자비로 치료하는 경우도 있다. 이처럼 그들이 위법적 부당한 처우에서 일하고 있는 것은 사회구조적 문제와 더불어 법령의 미비한 점도 큰 몫을 하고 있다. 청소년배달노동자의 실태를 문헌·설문·면접조사의 방식을 통해 분석하 였다. 이를 통해 원인을 규명하고 최소한이라도 해결방안을 도출하고자 시도 하였다. 특히 법규 위반 및 법령의 미비점을 중점으로 고찰하였다.

영문 초록

The heritage of Gwangju and 5.18 Democratization Movement does not simply belong to Korea but also Asia and the world. Gwangju Human Rights Charter reveals and declares such a value of Gwangu in a clear manner. This contains the universal human value, not the value for a certain region or group. Particularly, when it comes to human right, the consideration matters for those who are alienated from the society but should not be neglected. In this context, the juvenile delivery laborers as the social weak are the typical subjects to whom its genuine value should be applied. The juvenile delivery laborers are subject to physical and social protection with care and concern. Especially, the constitution and various labor-related laws order that they should be under special protection by the application of children labor. On the contrary, however, it is the reality that they are much annoyed with exploitation and disinterest. Those involved mostly in the shoestring businesses work in the business place with less than 5 full-time employees. Most of them are exposed to the almost uncontrollable dead zone regarding Labor Standards Act. Faced with a high chance of diverse dangers, they do the delivery job in a motorcycle. Though not less respectable than others as a worker, they are deprived of the due right under the name of ambiguous side job or what people call ‘arbeit’. Among others, the special employment generating a serious distortion in employment structure recently has been in danger of deprivation of even the minimum labor right since its initiation in the field of food delivery service. With a slightly over minimum wage, the allowance for either overtime or weekly holiday is not considered at all. In addition, it is lucky for such workers if they are not undercut due to a variety of problems while in work. They often deal with the medical fee themselves caused by an accident from speeding to meet the overly requested orders, being afraid to stop working not to mention the workmen’s compensation insurance. The situation leading them into this illegal and unfair treatment is largely due to the lack in proper act as well as the socially structured problem. The status about juvenile delivery laborers was analyzed through literature review, questionnaire, and interview survey for this study. Based on the analytic results, the causes were examined and the possible solutions were suggested as a minimum level of alternative. Above all, this study focused heavily on the violation of laws and the short points related to them.
